- [Narrator] It all
started in the late 1800s,

about 75 miles east of Dublin, Texas,

in the wild frontier town of Waco,

nicknamed Six Shooter Junction.

(gun firing)

Waco was home to Wade
Morrison's Old Corner Drugstore,

a prominent business and
a popular meeting place

in downtown Waco.

One of Morrison's employees,

a pharmacist named
Charles Alderton noticed

how customers loved the
smell of the soda fountain

with all the fruit,
spice, and berry aromas.

He wanted to invent a drink

that tasted the way the
soda fountain smelled.

(upbeat music)

After much experimentation,
some hits and misses,

he finally felt he hit
on something different.

The locals loved the new unnamed drink

and would order it simply by
yelling out "Shoot me a Waco!"

- [Man] Shoot me a Waco!

- [Man] Shoot me a Waco!

- [Man] Shoot me a Waco over here!

- [Narrator] But Charles
had another name in mind.

He was in love with a girl

back in his home state of Virginia.

(kissing)

Her father was a doctor

and Charles needed his approval

in order to marry his daughter.

Alderton named the drink after the doctor.

Dr Pepper!

Alas, Charles's tribute
to the doctor didn't work,

as he was not impressed
and neither was the girl.

Well, not long after that in 1891,

a businessman named
Sam Houston Prim tasted

Alderton's concoction and knew right away

he could bottle and sell it.

Prim had just opened a
new Dublin Bottling Works

in the growing town of Dublin, Texas.

They would become the first
facility to bottle Dr Pepper.

(pen scribbling)

On the back of the franchise agreement,

Sam Prim drew out his chosen territory,

a 44 mile radius around Dublin.

This small area was chosen

based on how far a horse and
cart could travel in a day.

By 1930, it was clear
that bottling Dr Pepper

was a huge success for both
the company and the town.

One day, in 1933, a 14 year old boy

named William P. Kloster
walked through their doors.

Kloster's father had
died a few years earlier

and he was looking for a
job to support his family.

W.P., as he was known,

quickly became their most loyal employee.

By the 1940s, World War II had begun.

W.P. Kloster answered the call of duty

and enlisted in the army.

He was shipped overseas and
quickly found himself in combat.

(cannons blasting)

He even shared a Dr Pepper
with a Russian soldier,

a controversial decision at the time.

After the war ended, he turned
in one uniform for another

and returned home to his job
at Dublin Bottling Works.

Not too long after W.P.'s
return from the war,

Sam Houston Prim fell ill and passed away.

Before he passed away, he made the choice

to leave the business in good hands.

W.P. Kloster would now
run the daily operations.

Outside of Dublin,

the Dr Pepper Corporation
moved their headquarters

from Waco to Dallas.

They slowly began to expand from Texas

to the rest of the country.

(upbeat music)

Showing love for his product
with tireless promotion,

W.P. Kloster soon became known

as Mr. Dr Pepper.

Little did W.P. know his biggest
challenge was ahead of him.

He would be confronted with a choice

that would alter the path
of the company forever.

The soda industry was moving
away from pure cane sugar.

Corporate Dr Pepper had
already made the choice

to switch to high fructose corn syrup.

Now the hard choice was up to W.P.

Either stay with the more
expensive original sugar formula,

or switch to the cheaper
high fructose corn syrup.

- I been in the Dr Pepper
business since 1933

and I've always enjoyed a good Dr Pepper

and I hate to see it bottled
with blend sweetener.

We don't believe it will break us

by staying with pure cane sugar.

- [Narrator] And with that,

the legend of Dublin Dr
Pepper was solidified.

A drink made with the original
pure cane sugar formula.

(upbeat music)

- It gives a little more bite to it

because sugar is a little
sweeter than corn sweetener.

They come in here and take a taste of that

and they say "Oh, that tastes
like the real Dr Pepper."

It is a lot of work

but I would like to stay with
tradition as long as I can.

(calm music)

- Sugar was more expensive

and it cost more to produce it,

but we didn't charge a premium price,

so our margin went down as
compared to other bottlers.

But we stuck with it.

My grandfather wrote a
letter to the chemist

at Corporate Dr Pepper in St. Louis

and he asked "Don't you believe
that the original formula

"Dr Pepper made with
pure cane sugar is closer

"to the original and a better product?"

The St. Louis concentrate
manufacturing facility

agreed with him.

(typewriter clacking)

"It is closer to the original
formulation of Dr Pepper.

"It is closer to the original taste.

"And yes, it is a better product."

My grandfather was a stickler

for dance with the one who
brung ya kind of a deal.

And he stuck with sugar.

He insisted upon it.

Nobody mixed the syrup
other than him personally.

No one.

- He was the biggest promoter

of the Dr Pepper brand that ever lived.

He would drive around
town with cold Dr Peppers

in his truck and if he saw somebody

that he thought might enjoy one,

he'd stop his truck, get out,

get into his cooler, and give 'em away.

- [William] Y'all wanna try
a cold one while you're here?

See if you can tell any
difference in that now.

- That's the real thing.

- [Man] But that's the
slogan of that other drink.

- She meant the real Dr Pepper.

- Bill Kloster drank a Dr
Pepper several times a day.

- I drank 10 to 12 a day

and I even drank it when
I go home for supper.

- And Iona got so upset about that.

She told him he had to
drink Diet Dr Pepper.

And he got around that by
putting Diet Dr Pepper bottles

in the bottle washer with the
regular Dr Pepper bottles.

And they went through the line,

through the regular Dr
Pepper bottling process.

For a while, I think she was snowed

but I think she eventually realized

that's not Diet Dr Pepper
that he's drinking.

- He's the guy that everybody laughed at

because he kept every piece
of advertising material

that Dr Pepper ever put out.

- Most of the advertising I have here,

I saved over a period of time.

I stuck it back.

I don't know why.

My wife says that I save everything,

don't throw nothing away.

- Stored it away.

We had more damn warehouses
in Dublin full of stuff

that my grandfather
kept every piece of it.

- If it hadn't been for Billy saying

"I'm not gonna send this stuff back.

"It's gonna be valuable to
the history of Dr Pepper,

"I'm not gonna send it back."

Well, he preserved history.

- First thing you know, one of em's saying

"I remember this piece.

"My daddy run a store, he had this piece."

And it brings back
memories to these people

and it brings back memories to me too.

- Bill loved Pretty Peggy Pepper.

(upbeat music)

He loved her so much

that he decided that the spokesperson

for the bottling plant here in Dublin

would be Pretty Peggy Pepper.

And he started a contest to
name a Pretty Peggy Pepper.

And I remember one photograph
where's he's just surrounded

by Pretty Peggy Peppers and
he has this grin on his face

you wouldn't believe.

- [Woman] This summer, for the first time,

Kloster is selling sugar
cane Dr Pepper in cans.

It's taken years to find
a can company willing

to use sugar in Dr Pepper concoctions.

Temple's plant finally agreed,

although it cost Kloster
31 cents more per case

to use imperial sugar.

- We got people driving from
all parts of the country

to buy up 10, 15 cases of Dr Pepper.

They come in here from
Fort Worth, Dallas, Waco.

- [Narrator] Kloster's unique
product grew so popular,

he had to expand the
warehouse to meet demand.

With Dublin's limited distribution area,

customers traveled from all over

to buy the original formula Dr Pepper.

They soon became known as
modern day bootleggers.

- People would come to Dublin to buy it

and then take it home.

And so that is technically a
violation of your franchise.

For true franchise, you're
only supposed to sell

for consumption within your defined area.

- [Narrator] Now remember,
Dublin Dr Pepper is bound

by the same 44 mile, six county territory

they originally agreed to in 1925.

- The consuming public
started to get a real kick

out of being a Dublin
Dr Pepper bootlegger.

(upbeat music)

(tires squealing)

Became a lucrative market
for a lot of people.

People would take it
and send it everywhere.

- I knew about Dublin Dr Pepper

almost from the moment I was born.

Fact of the matter is,
my dad used to drive

to far away places from Dallas

to meet a guy in different locations

to buy Dublin Dr Pepper out of his trunk.

I guess I had some friends
whose dads made drug deals,

my dad made Dublin Dr Pepper deals

out of the back of a trunk.

- Well, I'm going to Dublin.

I'll pick you up, everybody on the street,

I'll pick you up two cases.

Across the street there,
I'll pick you up three cases.

I'll just go down there
and I'll bring back a bunch

for all of you.

(tires squealing)

- We have one gentleman
who goes to Dublin,

buys the product.

He then delivers it to
the Patillo feed store,

where someone's there going "Okay, Rocky,

"you know, your soda's here
from those guys up in Dallas."

Rocky comes over, grabs all the soda,

takes it back home to Stephenville.

And the next week when he comes up,

would deliver us our soda.

We got dinged from the guy
picking it up in Dublin,

the bootlegger.

Then we got dinged from Rocky,

just to sell it to our guests.

And so, you know, there's
like three middlemen,

you know, throughout this whole process.

- They didn't have a way

that they could shoot out their tires

and say "Whatever you do, do
not get past that 40 miles.

"We gotta stop there."

(glass shattering)

Well, then laws started changing.

Laws started changing on bottling drinks,

on fountain drinks,

on the way that the drinks were produced,

and there was the laws

that all of a sudden it allowed them

to go over 40 with certain things.

- It was funny, I remember
when Dublin first started

making it available via mail order.

I had several cases of it

in glass bottles sent to the office.

And I'll never forget the
most disappointing moment

of my life up until that point

was when half of the cases
showed up completely smashed.

(glass shattering)

And the packages were soaking and soggy

and I was contemplating do you get a straw

and suck the Dr Pepper
out of the cardboard

and decided that was probably a very bad

and disgusting idea.

- We capitalized on it and made a T-shirt,

which was real popular

until Corporate Dr Pepper got wind of it

and decided they didn't like that so much.

- [Narrator] In 1995, Bill's
wife Iona Mae passed away,

leaving him without his anchor.

And not too long after that,

the world lost Mr. Dr Pepper.

Today when you visit Dublin,

Mr. Dr Pepper still stands tall.

His statue includes the
things he loved most.

Hard work, Dublin Dr Pepper,

and if you look real close,
his wife Iona Mae Kloster.

(gentle music)

- He was buried with a
Dr Pepper in his hand.

And then we put these bottles on there.

It was September.

He had designed the
calendar for the next year,

for the 2000 calendar.

So he left the plant, it was about 5:15

and went up there, pulled
up to the gas pump,

he was gonna deliver drinks,

and had a massive heart attack.

(upbeat music)

- My earliest memories
are of coming to the plant

with my dad.

Actually got my first job
here, sorting bottles.

Whenever I walked into this place

and just started walking around
and looking at this place

and the history, been such
a critically important part

of all of our lives.

- I guess you would call
me the head soda jerk.

I run the soda shop there

and I give guided tours
of our bottling plant

and museum every day.

Pretty much a labor of love,

it's something I really enjoy doing

and enjoy all the people that we get in.

We get about 70,000 people
from all over the world.

I get a chance to show them

why Dublin Dr Pepper is so special.

This was kind of a dream job actually.

I wrote a paper in school
about one day wanting to work

at the Dublin Dr Pepper plant.

And my mom, you know, like any mother,

she kept all my papers
and she found this one day

after I'd gotten this job

and she said "It really
is your dream job."

But believe it or not, I
met my wife at the plant.

She started working here
about three years ago

and we recently got married back in May.

She doesn't work here anymore,

so we had to do a little split there

but you know, you know how that goes.

- [Narrator] The century old bottling line

needs continuous maintenance.

Held together by duct
tape and bailing wire,

as they say in these parts.

- Right now, I could take it apart,

you put a blindfold on me,

and I can still take it apart
and put it back together.

That's how many times I done it.

I know about where the holes are

and that's all sometimes
I do, just by touch.

And I don't know how
else to do it, you know?

It's, ow.

If it's a hidden place
where nobody can see it.

Yes, I play a little Southern engineering.

That's the way I was taught by
my dad, Southern engineering,

and a lot of Southern
engineering does work

and gets you out of the tight places too.

So.

(upbeat music)

- [Narrator] For such a small town,

Dublin actually boasts more
than its fair share of museums.

But somewhere in the midst of it all,

hidden from the general public,

there is a secret museum
full of hidden treasures.

Sworn to secrecy, our
cameras were allowed in.

- And his collection, we are told,

started when he went off to war.

And his wife saved calendars for him

so when he came back, he had
the start of his collection.

This room, I call the metals room

because everything in it is metal

and we monitor it for
temperature and humidity.

It is an undisclosed location.

We don't tell anybody where it is.

Only a handful of people
know what's down here.

Well, when I came, this
is what they showed me,

what was in this building.

And everything was in
just boxes here and there

throughout the building.

And after I'd been here for a month or so,

somebody said something

about something was across the street

and I said "Across the street?"

And they said "Oh, haven't
you been across the street?"

No, so let's go across the street.

Well, here's another building

and it's full of machines
and bottling machinery

and it has a second floor
and there are things

all over the second
floor of that building.

Okay.

He loved clocks and thermometers

so we started putting
'em all in this room.

This is a clock that has
a color wheel behind it.

And then one day, somebody said

"We need to go and get
a pallet of crates."

And I said "Well, where are those?"

"Well, we have this
place out on the highway

"where they're stored.

"You haven't been out there?"

"No, haven't been out there either."

I opened up the lid

and there was a hand grenade
sitting right on the top.

We have more library in here

and every year they published
a bottler's catalog.

By the end of the first year,

I knew that I would not be
through at the end of four years

because the collection
grew and grew and grew.

From the 70s.

Here's 50s, 70s, 60s.

These bottles are 1940s bottles.

These are from the 50s.

And I think we finally found every place.

- [Narrator] Austin has become

Dublin Dr Pepper's largest market.

On any given day, you
will find Jeff Kloster

hand-delivering cases of drinks

and stocking soda fountains
at local businesses.

Dublin Dr Pepper has
become so popular in Austin

that they've had to open a
regional distribution center.

(static buzzing)

- Right now, Dr Pepper officials

are filing a lawsuit
against the small company,

claiming they don't have the rights

to put Dublin on the Dr Pepper name.

But it's not just the name Dublin

company officials want gone.

Right now, this gift shop
will send merchandise

and the product out of state,

something company
officials say is illegal.

- [Woman] Bitter is how you
might describe the relationship

between Dr Pepper and its Dublin bottler.

Tuesday, parent company Dr Pepper Snapple

filed a federal lawsuit
accusing the Dublin franchise

of violating its distribution agreement.

"In the simplest terms,
the bottler in Dublin

"is using a logo that
is no longer authorized

"and is taking business from
fellow Dr Pepper bottlers."

- I think they oughta be able
to ship it wherever they want.

There shouldn't be any restraints on that.

- The parent company said
this is not about the numbers.

It's about signing an
agreement and sticking to it.

- Either they will have to
resolve this with Dr Pepper

or Dr Pepper will and can
put them out of business.

- Don't need that change.

- [Woman] News that had
long time Dublin resident,

Clay Estes, wiping away tears.

- It's just a big draw for the whole town.

Everybody gets,

somebody'll go through their store

that normally wouldn't've,

just because they came
to Dublin Dr Pepper.

- [Woman] Dublin Dr Pepper,

the smallest and oldest
distributor of the soft drink,

fired back today in a lawsuit.

- [Woman] And everyone
here is ready for a fight.

And together, they have one clear message.

- Oh, take a chill pill, you know?

And wash it down with a
good Dublin Dr Pepper.

(laughs)

(solemn music)

- [Man] And some breaking news tonight,

the end of an era for the
Dublin Dr Pepper bottler.

Big changes coming to the Texas tradition

and tonight that means layoffs
for some Texas workers.

- [Woman] That tradition and
much of Dublin's identity

was drained yesterday when the corporation

and the bottlers settled a lawsuit

and production of the
Dublin Dr Pepper stopped.

- My grandfather grew this thing.

Dr Pepper has always been
a vital part of Dublin.

- [Man] That is Jeff Kloster.

He is the owner and the vice president

of Dublin Bottling Works

and it's a tough day for
him as it fell to him

to end a chapter in Texas history.

- [Woman] All signs with
the Dublin Dr Pepper logo

also had to be removed
as part of a settlement

with the Dr Pepper Snapple Corporation.

- [Man] The final chapter
in a legal battle won

by the Plano-based Dr
Pepper Snapple group.

More than 70,000 people
visit Dublin every year

to see the legendary bottling plant.

It's a sad day for the folks

who have worked at the
Dublin plant for decades.

- [Man] And what wasn't cut
down or put away was covered up.

- [Narrator] Besides
removing the word Dublin,

all unapproved slogans had
to be covered up as well.

(solemn music)

- We were up front cleaning
out some more of the soda shop,

I saw that first truck.

And the reality struck.

It's...

It's getting transported
out of here today.

So what was once a full proud warehouse,

be empty for a while.

And then I've gotta meet the
Dr Pepper representatives

to do the final pass
through on the soda shop

to make sure that we got
everything outta there

that they deemed to be
inappropriate material.

- [Narrator] As the warehouse

and soda shop are being emptied,

the last bottles of Dublin
Dr Pepper roll off the line.

(calm music)

That morning, Jeff Kloster
found an antique crate

with his grandfather's
handwritten name on it.

The last bottle of Dublin
Dr Pepper was placed in it

and carted off.

- Really right before Christmas,

says "Well, we're really
not interested in settling.

"We just wanna buy ya."

And firstly, it was they
wanted to buy everything.

The museum, soda shop, all
the memorabilia, everything,

and I said no.

That part of our business is too important

to the town of Dublin.

I'm not, I will not sell
you my dad's memorabilia.

I will not sell you my museum
in the honor of my dad.

You know, I'm not gonna
sell you the soda shop,

so they backed off of that.

And then the agreement was

then they would buy out
our Dr Pepper franchise,

if you will, and our distribution

within the six county area.

So you know, shared the press
release with the employees

and gave 'em a chance to read it.

A few of them, very few,
about four of the employees,

they were in that end of the
business, we're keeping on

to support our ongoing business.

And I excused them

and the rest of the folks that were there,

I says "Unfortunately what this means is

"your job is eliminated."

And that was...

That was tough.

- [Woman] Now my understanding is

that you had 14 workers
who were let go today,

is that correct?

- Yes ma'am, that is correct.

They are from the literal
sense of how closely we worked,

they are what I consider
part of my family.

They're not blood family,

they are part of the
family and it was hard.

The idea that the name
Dublin Dr Pepper goes away

is certainly gonna have
an effect on some people.

And the folks in town
are probably wondering

exactly what it means.

But Dublin Dr Pepper is no
longer here as of today.

(calm music)

- Dublin Dr Pepper was able
to withstand World War II,

high sugar prices, and a recession.

They were like the
little pepper that could.

They just didn't know
that they wouldn't be able

to withstand the pressure
of their parent corporation.

(dramatic music)

The first complaint that
Corporate Dr Pepper made was

that Dublin was improperly
using the term Dublin Dr Pepper.

Number one, you approved
in writing the use

of Dublin Dr Pepper in the
graphics on the bottles,

on the cans, and on the merchandise.

Second, in the Corporate
Dr Pepper magazine,

they specifically referred to
my client as Dublin Dr Pepper

going back as far as 1999.

So even Corporate Dr Pepper

was using the term Dublin Dr Pepper.

Third, on the Corporate Dr Pepper website,

as recently as 2011, just
months before they sued us,

they had a link to Dublin Dr Pepper.

I mean, the link specifically
said Dublin Dr Pepper.

And fourth, the chairman of the board

of Corporate Dr Pepper
had been on television,

broadcast throughout the state of Texas

and probably throughout the United States,

specifically talking
about Dublin Dr Pepper.

- What about Dublin Dr Pepper?

Wasn't that the first?

- Eight ounce glass bottle.

There's nothing tastes better

than a Dublin Dr Pepper
when it's ice cold.

- He said Dublin Dr Pepper.

Not imperial sugar cane Dr Pepper,

not Dr Pepper made in Temple,

he said Dublin Dr Pepper.

And yet not long after that,
he took his gigantic foot

and stuck it on the little scrawny neck

of Dublin Dr Pepper and said "Screw you."

- It was our understanding
that the defense counsel

for Dr Pepper Snapple Group claimed

that Mr. Young wasn't speaking
as the CEO of the company

while he was on the program "CEO."

- And Texas Monthly
Magazine ran a cover story

on "The Bucket List",

the 63 things you should
do before you die.

And among the top 10 was
drinking a Dublin Dr Pepper.

1991, the Texas legislature
issued a proclamation

honoring Dublin Dr Pepper.

Specifically calling it Dublin Dr Pepper.

And the second complaint that they raised

was that Dublin was selling
outside its 44 mile,

six county territory.

We said "Yeah, we have been
selling outside the county

"but you asked us to."

We were able to produce
documents reflecting

that Corporate Dr Pepper
had specifically asked

that Dublin send the Dublin Dr Peppers

to corporate headquarters.

They had specifically asked

that Dublin Dr Peppers be sent to Dallas

to the homes of Corporate
Dr Pepper officials

and employees.

And my thought was if you had a complaint

with the term Dublin Dr Pepper,

couldn't you have told us
about it 120 years ago?

- I've got an interesting
perspective on things

because before I was
doing this travel show,

I was a trademark attorney.

And so I actually worked
for a giant law firm,

sending really ugly
letters to small businesses

all across America.

My initial reaction
was they can't do that!

You know, this place,
there's things in the law

that if you've been doing
something long enough

and the person hasn't
complained about it yet,

then you get to keep doing that.

Basically you, you know,
raise your hand now.

It's like at a wedding, you know?

Speak now or forever hold your peace.

Well, when a brand
starts using a trademark

and you don't say something

and you let them build an entire business

around that usage of a trademark, well,

you've lost your right
to complain about it.

And so it's not a matter

of who would ultimately win the lawsuit,

it's a matter of who can fund the lawsuit.

And the small one's always gonna fold.

(popping)

- Partially, I've worked in this business

for over 20 years and I have
never seen, in all my life,

the public reaction to a lawsuit

that was generated by this.

- There's a war happening online

and Plano-based Dr Pepper
Snapple appears to be losing.

- [Woman] Because the
internet is overflowing

with the voices of
Dublin Dr Pepper drinkers

who won't remain silent.

Facebook has an Occupy Dr Pepper page.

- It's all about the fat cats at the top.

They got what they wanted.

Dublin Dr Pepper no longer exists

but the blood left on
the floor was massive.

- [Woman] "Shame on DPS."

Even Dr Pepper's own Facebook page

was sprinkled with complaints.

"Dr Pepper, you are a buncha bullies!"

- I'm pretty upset, to say the least.

Devastated might be a better term.

- The little guy being taken advantage of

by the big corporation.

- [Man] This is about the existence

of the small town of Dublin.

They rely on that drink to stay vital.

- [Woman] Take a look at
what we found on eBay.

Someone is trying to sell a
case of the soda for $10,000.

- The people of Texas believe

that Dublin Dr Pepper was theirs.

Like the University of Texas is theirs,

like the Alamo is theirs.

Dublin Dr Pepper was part
of the fiber of this state.

- We've always had Dublin Dr Pepper.

It's an Austin favorite.

Pretty much 70% of our drink
sales was Dublin Dr Pepper.

And they've been so good to us,

we figure we'll have one last bash

by whoever buys a large
Dublin Dr Pepper tomorrow

gets a free T-shirt.

You know, just a little way
to show our appreciation

to them for being so good to us.

- It's insane.

The cars are lined up, blocking traffic.

Anticipate this to be our
biggest day ever in sales.

This is a very sad day.

This is very bittersweet.

- When the stuff started going down

with Corporate Dr Pepper, we'll
call 'em Dr Pepper Snapple.

What are we gonna call 'em anyway?

Sons of bitches, I don't know, whatever.

We decided through social
media to gather together

and to boycott Dr Pepper
and all their products.

Snapple, Hawaiian Punch,
it goes on and on.

It's like a soft drink monopoly
like nobody's ever seen.

We lay low some weeks

and some weeks we're all over 'em

like a bunch of wild dogs.

And it's not gonna stop.

The fact that the Snapple people roll in

out of New York City,

it's almost like the Pace
picante sauce commercial.

Made in New York City?

This poster pretty much says it all.

This poster right here typifies

pretty much the way we feel in Texas

and how we feel about the Dr
Pepper Snapple Corporation.

You guys, gutless cowards
that you are, came in

and basically squashed the
heritage, the hard work,

and the beauty of this small town

and the product that
so many of us enjoyed.

And you oughta be ashamed of yourselves.

Corporate bullying, we're not
gonna stand for it in Texas.

- And Texans don't take well

to the wrecking of landmarks,

to the wanton destruction of something

that meant so much for so long.

- But it was literally a
developer heaven in Dallas

until the biggest, most
wonderful, beloved building,

which was the art deco building

that was Dr Pepper's headquarters.

And when Dr Pepper Corporate
allowed that building

to be demolished, it really
made Dallasites realize

that holding onto their
beloved older buildings

was an important part of the future.

We changed the code,
the preservation code,

because Dr Pepper let that building go.

It was a huge big problem for the city.

Well, now it's a grocery store.

And while Kroger is a good
big supporter of Dallas

and has helped in many different ways,

it's not the old Dr Pepper building.

And what's really upsetting
to me is this theme

of Dr Pepper Corporate,
this ongoing theme.

You know, decade after decade,

that they just have no
respect for history.

And it's one thing to let a building go

but when you start affecting
people's livelihoods

and their small towns, I mean,

what they've done now
with Dublin is way beyond

what anyone thought they were capable of.

And if Corporate Dr Pepper had any sense,

which they don't obviously,

they would have gone down
and made Dublin the center

of their national marketing campaign.

Not even a close call.

You know, Disneyland has
to make a Main Street

to make people feel good.

And here you've got Dublin,
Texas right down the road

from where you're headquartered.

It's so real.

It's so perfect

that if you're a corporation
with any sense at all,

you wanna bottle that and make it your own

and tell the whole world that, hey,

we own this wonderful slice of Americana.

Well, they have to have the
worst PR people in America.

That's for sure.

- They lost the greatest
marketing of all times.

I can't believe it.

And I watched the commercials.

You know, there's one
that Dr Pepper has now

about it's not for women.

- It's only 10 manly calories

but with all 23 flavors of Dr Pepper.

It's what guys want.

Dr Pepper 10, it's not for women!

- And so to go in saying
"Girls, you can't drink this one

"because it's only for men."

Right there, you have just offended,

just offended half the population.

- If there's malfeasance

and if anybody was in the wrong here,

it was Dublin Dr Pepper

and everything they're suffering now

is a self-inflicted wound.

They did this to themselves.

(bottle smashing)

If you have this enormous
franchise of Dr Pepper

and you spend countless
millions of dollars marketing it

to create this image,

you're being cannibalized
by your own bottler.

You've got a bottler who
infringes upon your trademark

by adding his own name to the label

who has no right to do that.

Who starts selling the
product in other places,

inferring that it's a better
product than Dr Pepper.

And how much patience do you have

with this sort of interloper

who suddenly for I think
very prideful reasons thinks

that they can take
advantage of this situation.

If there's a good guy here,
it's Dr Pepper Snapple.

They didn't do anything wrong.

They were just simply trying
to protect their own trademark

and identity from someone
who had the hubris

to poach upon them.

And you will let a bottler have space,

they have a great tradition,
it's a small town,

and I think there was
a tremendous tolerance

on the part of Dr Pepper
Snapple to allow them,

until the point where it just
became somewhat outrageous,

where they finally simply
pulled the cord on them.

Because no company can allow
an encroachment like this

by a little company.

There's no such thing as bad publicity.

The only thing that's happening here,

no matter what your film reveals

or what positions are presented,

it's a film about Dr Pepper.

Every time the name Dr Pepper,

no matter it's used, appears in the media

in any way, shape, or form,

it just adds to the barb
in the consciousness

of the American public.

No matter how it's portrayed,

the name Dr Pepper is out there.

In a lot more cases, most of the people

who have very short
attention spans see it,

identify with it, and
probably that night go out

and drink another Dr Pepper.

The important thing here is to realize

that this entire heritage
is based upon a trademark.

That trademark is Dublin Dr Pepper.

Take away the Dr Pepper,
you ain't got much.

- [Narrator] After the settlement,

Jeff receives a call
from an anonymous source

who reveals some interesting information.

- [Man] You know, if they'd
just taken the Dublin out,

is that what would have done it?

And he said "You know, what
really caught our attention

"was not the Dublin in
the Dublin Dr Pepper.

"It was not the trans-shipments.

"What really got this
going was the cake mix."

- What?

- [Man] Yeah, he said that
what really got it going was

when they did searches, it came out

that you were selling Dr Pepper Cake Mix.

- Well, yeah, they knew about it.

- [Man] I'm just saying,
that is what got them.

That is what really got them.

- That is the most asinine thing

I've ever heard in my life

because Debbie went up
there a number of times

to get them to grant her a license

and they blew her off every
time she was up there.

- [Man] The invention of fourth
grade teacher Debbie Mormon.

Debbie has a cake mix business

and a couple years back
while assembling her wares

for Dr Pepper Days, inspiration!

- So I rummaged through
my family's recipes

and I came across one that
I thought would complement

the Dublin Dr Pepper
flavor, be easy to make,

you can dump it all in
the mixer at one time.

I made one, it was absolutely delicious,

so I packaged it up and I
took 'em to the Dr Pepper Days

and it sold out by 11 o'clock.

- And I just, that's baffling.

- [Man] It's because it wasn't licensed

but I found that strange

that's what sort of
caught their attention.

It went from there

and then it became the larger issue.

- There's Bigfoot, there's
the Loch Ness Monster,

and there's why did Dr
Pepper kill Dublin Dr Pepper?

Maybe one day we'll find out the answers

to one of those.

- Will Dr Pepper talk to you?

I don't know.

I doubt it.

- I would see them saying

that we see nothing good from
coming out of us talking.

- You know, we make the concentrate,

we own the brand, the trademark,

and the secret formula, all of that.

And we sell that concentrate
to all the bottlers.

They add carbonated
water and the sweetener

and then they put it in
the bottles or their cans

and they sell it in their territory.

In the last few years, and
this is said in our lawsuit,

this is one of the things we alleged,

is that the Dublin bottler was not staying

in their territory and therefore sales

of neighboring bottlers were being hurt

and they were losing sales.

So that's not fair, so we have to step in

to protect the brand.

People may have gotten confused.

There's maybe some emotion down there

when they didn't really understand

what the disagreement was about.

It was really about the territory

and protecting the neighboring bottlers

from sales that should've
stayed in those six counties.

It really wasn't so much
the merchandise issue

and at the end of the day,

we both reached a win-win agreement.

I think they were pleased
with it and we were pleased

and we still have a very
good relationship with them

and particularly we
support our Dublin fans

who love Dr Pepper.

I've grown up with the brand

and I can't tell any difference

between the corn syrup or the cane sugar.

Some people claim they can taste
a little bit of difference.

I can't.

Cane sugar Dr Pepper is less than 1%,

probably a lot less than
1% of our overall sales

of the brand Dr Pepper.

And you asked about the production

of the eight ounce glass product.

There's maybe a little
confusion about that

but that product, actually this product,

really wasn't made in Dublin
for about the last decade.

They outsourced production to Temple,

another family-owned bottler.

And if you look at the cap,

it says Temple Bottling
Company right there.

And I think over time,

people will understand
what really happened,

that this was a win-win agreement

for the Dublin bottler and
for the brand Dr Pepper

and for Dr Pepper's fans.

- Number one, he'd say "Don't give up."

First and foremost.

That's the part that's
driving me everyday.

I think he would be in a lot of disbelief

and he'd be angry.

This business started
as Dublin Bottling Works

and now 120 years later,
right back to the name

that existed on the front
of that building in 1891

and we have a plan.

- To produce cane sugar,
superior carbonated soft drinks

in glass bottles and on the fountain

and see how far we can really take it.

- We're not limited by
geographical restrictions anymore.

We have our own proprietary flavors.

- We're here and we're gonna
be bigger than we ever were.

- [Narrator] Dublin's new lineup

includes a dozen custom flavors,

all with the Dublin Bottling
Works name and logo.

And all produced with the same ingredient

that they began with, pure cane sugar.

Grassroots marketing of the
new product begins in Austin.

Samples of the drinks are being delivered

throughout the city.

- [Jeff] Well, I got a bunch of drinks,

I got 10 cases of the Dublin
and this is the last of it.

to unload the last of the Dublins.

- [Jeff] All my new flavors
are in this guard shack.

Dublin Triple X Root Beer.

And that's only a week.

- The cola that we installed
last week is already gone.

This is a good time for me.

That you've got cola up here

and you don't have any
of the major brand colas

and it's the first one out.

That's very uplifting for me.

We installed this machine, we'll fix it.

I don't mind if they call me

and say "Come in, something's
not working right."

I'll come in and fix it myself.

The hell these guys keep
doing to this damn thing?

I don't have my ratchet set with me.

- Melvin is not unlike
an independent wine maker

somewhere in the middle of France.

You know, you can buy
a cheap bottle of wine

in any electric store

but if you want the best bottle of wine,

you've gotta go to France to get it.

And Dublin is Melvin's France.

And if you've seen him mixing
the sodas, you can tell.

He's got a taste for it
that none of us have.

He knows exactly what to do

and when to stop and when to start.

He's a genius, he's a savant.

- That's good.

Fantastic.

It's 20 bags of 50 pound bags.

1,000 pounds, then I add
another 20 pounds to it

and that'll be complete.

I always taste the syrup by itself

and I keep on adding until
it gets the right texture.

It's gonna spill everywhere,
but we'll get it.

Throughout my childhood, I thought, well,

how cool it would be to
me be standing there,

mixing drinks, you know?

I think it's a very wonderful thing

that's ever happened to me.

You know, I wish my dad could see me now.

But hands on is the best,
the best way to learn.

Here it comes.

And I found out kind of reading it

or people telling you, I'd
rather sit there and do it.

I mean, I can catch on
really, really fast.

But my favorite is grape.

And it is always good.

My whole family likes
grape, so it's fantastic.

- [Narrator] As Dublin fights
for shelf space regionally,

it's an uphill battle

in a crowded independent soda marketplace.

Will the distinction of using
pure cane sugar help them

or hurt them?

- Soft drinks are right
now flat or declining

and the reason for that is the
national epidemic of obesity.

There's probably nothing
worse to put on your label

than the word sugar, because sugar means,

for children especially,
they're putting on weight.

And this is an immensely
serious problem in our culture.

- The obesity problem in America really

is very much a crisis at this point

and you have to look at the numbers,

where one out of every three children

is now deemed overweight or obese,

which deeply saddens and concerns me

because they don't even get a fair shot.

To basically stop the rise
in obesity in children,

it would only take a 42 calorie change.

We only need to find 42 calories
in the average child's diet

to pull back on to stop the uprising,

the trend toward obesity.

42 calories.

Well, that's 1/3 of a soda.

We need to eat less of it.

We need to have less of
it go into our bodies.

And whether it's that we reduce that

in the form of the high
fructose corn syrup products

or from sugar products or whatever,

we're just in excess and
that's really the bottom line.

- So when you look at the rationale

for how this company's going forward,

the idea that they're
using pure cane sugar

is something that is not going

to terribly advance their cause.

- [Narrator] Everyone is wondering

if Dublin Bottling Works can succeed,

especially the town of Dublin,
already feeling the impact

of losing the region's biggest draw.

Since Dublin Dr Pepper ceased production,

visitors are not stopping
like they used to.

All this has left Dublin
wondering what is next?

- The town's concerns are far from over.

Today, families turn to a higher power

as they face an uncertain future.

- People lost their jobs,
everybody knows about that.

- [Woman] Heading to Sunday
services to pray away the pain.

- And I think we're afraid
of what's gonna happen.

- [Woman] To hear words of hope.

- But you know what?

God's gonna take care of us.

A lot of the business owners are afraid

it will affect their business in some way

because those people who come
to see Dr Pepper also stop

and eat at the restaurants,

they stop and buy things at our stores.

- My wife, Lisa, about four years ago

started The Three Sisters of Dublin.

It's been in business
since 1873 or something.

So it's been a working
store up to that point.

- In a situation like this,

you can't really make
a difference kind of.

You can't.

But in your heart, you can do,

make a little bit of difference.

So my sister and I
decided we're not happy,

we might as well let people know

that we're not going to
drink Dr Pepper anymore.

And it caused quite a
stir, I was surprised.

You took something away from us

and this is our reaction.

We had an identity.

When we said Dublin, people
would say Dublin Dr Pepper.

We had a reason people would
flock here in the summer.

I mean, good grief, when
you say Dublin Dr Pepper,

are you not supporting Dr Pepper?

In a positive way?

And now when you say Dublin Dr Pepper,

it's not in a positive way.

We're not going to let
Dr Pepper ruin Dublin.

It's a hard time.

I cannot stand here and be honest with you

and say "Oh, we're doing
fine, we'll keep on trucking."

We don't know.

The business since the middle of January,

the foot traffic has
decreased significantly.

Probably down 70%.

- You can drive down the
street in downtown Dublin

and see it has definitely
made a mark on the town.

A few years ago, every
building had somebody in it,

some kind of commerce was going on.

All of a sudden, it's like
what's Dublin gonna do?

♪ I drink Dr Pepper and I'm proud ♪

♪ I'm part of an original crowd ♪

♪ And if you look around these days ♪

♪ There seems to be a Dr Pepper craze ♪

♪ I'm a Pepper, he's a
Pepper, she's a Pepper ♪

ya like to be a Pepper too ♪

Pepper, she's a Pepper ♪

♪ If you drink Dr Pepper,
you're a Pepper too ♪

♪ Be a Pepper, drink Dr Pepper ♪

- The people of Dublin
might be facing a situation

in which this was kind
of their claim to fame

and they've, in a way, been betrayed

because a company went too far.

If I were a citizen of Dublin right now,

I'd be very, very angry.

- I was upset, a little
angry, disappointed.

- I've grown up here my whole life.

We have nothing to make somebody
go "Oh, let's go to Dublin"

except for the Dublin Dr Pepper.

- But I think it's a sad deal

that people came from miles away.

I mean, people from other states came

just to get Dr Pepper.

- Pure cane sugar was one of
the best drinks in the world,

as far as I was concerned.

And them getting rid of it, I
don't understand why they did

except for corporate greed,

just trying to kill the little man.

- It's Dublin.

It's what Dublin's known for.

- And that's most of the reason
that people passing through,

they come to Dublin because they want

to check the Old Doc Soda
Shop and Dublin Dr Pepper.

- And tour the bottling.

That's what's unique about it

is how it was bottled here and everything.

- For months after it was over,

you'd see somebody that was just angry.

If they saw a Dr Pepper
truck go through town,

they'd get so mad they
could hardly stand it.

And this was 80 and 90 year old women

that just couldn't handle it.

- I have pictures of my dog
drinking Dublin Dr Pepper

out of the little bottles.

She liked it almost as much as I did.

And that's part of Dublin, that is Dublin.

It was just a way to shut it down

and switch everybody to all that,

where's that made in, Dallas?

- Yeah, probably.

I don't know.

- I don't know either.

- I think what some of the problem was

was there's a bunch of restaurants
and so forth in Dallas,

their home office, that
were coming down here

and getting Dublin Dr Pepper.

Now I saw that on TV.

- We got a few messages,
either email or phone message,

saying "You sold out,
we don't support you."

That was the majority
of what the anger was.

But there was certainly some
at us, that we sold out.

- I was really disappointed
that they would gamble

on something as important
as part of our heritage

here in town to make more money like that,

and I think that's what it was

was trying to make more money.

- But I think it was a dollar
thing, you know, ultimately.

Somebody got some money.

- Usually if you look behind
stuff like that, it's money.

- They had a sizeable war chest of money

based on 120 years of doing good business.

And in one year,

they spent all of their
cash reserves on lawyers.

- It's a little troubling to me,

the number of people who
think that we're closed.

And Dr Pepper's not doing us any favors.

I have found on more than one occasion

that various employees of
that company had told people

that we shut our doors.

- [Narrator] At the Dr
Pepper Museum in Waco, Texas,

diehard fans can check out the memorabilia

of the birthplace of Dr Pepper.

You can even visit the pharmacy,

where Charles Alderton
first mixed the drink.

But even in Waco,

the effects of the
settlement are being felt.

- There was so much
publicity around the closing

of the Dublin Dr Pepper franchise

that a lot of people assumed
the museum was closed.

And our attendance has been down this year

and we think in part that's why.

Is people have come into the
convention center here in Waco

and said "Oh, the museum,
I thought that was closed.

"Didn't Dr Pepper close that down?"

And the convention people say "Oh, no, no,

"the Dr Pepper Museum is
still open here in Waco."

But people confused the two a lot

and it's been a little
bit of a negative for us.

I think people are very happy

when they find their way
here and hear the news

that there is still Dr Pepper
memorabilia here to view

and things to see.

But it has been a little bit
tough on us in that respect.

- [Narrator] Every June,
thousands flock to Dublin

for the Dr Pepper Birthday Celebration.

Since 1991, Dublin has
celebrated the anniversary

of bottling Dr Pepper.

People waited in lines that
wrapped around the corner

to get a glimpse of the
historic bottling line.

Today, there is live
music, the 10-2-4K Run,

and streets full of vendors.

In the past, you could even get a slice

of the infamous Dr Pepper cake.

- It's June in Dublin, Texas

and it'll easily approach 100 degrees

and it'll be humid and there'll be flies

because we're in dairy country.

It'll be freaking hot,
there's no doubt about it.

This has been one

of the most heavily
supported things we've done

is adding this tent, putting
the bleachers under it,

so people can enjoy the music
and sit under the shade.

It's gonna be different

but it's the first
birthday of the new entity

that survives the old entity

and we are still firmly in business.

We're here to stay.

- [Narrator] Jeff is feeling the pressure

to make the birthday party
a success for many reasons.

- That's one of the regrets of spending

this much time, you know,

handling the growth of the company.

The family at home takes the hit

and I'm not around as much as I could be,

or should be, for that matter.

Dublin Bottling Works is up as a supporter

of my son's school and
I tell him "Be proud.

"That's yours."

- [Narrator] The looming question is,

will anyone show up to the party

without the draw of Dublin Dr Pepper?

- If you guys were here January
12th, this place was empty.

It's now full again.

Beautiful sight.

All of our flavors.

Sugar to produce our bag and box.

Every rack in here's full.

It's very proud for us
as a family and as a team

to walk in here.

And we've got product that belongs to us

and we can sell.

It's awesome.

We had the sign up here like this

and we decided to change it over

to the Dublin Bottling Works,

so we took this sign down,

and put up the Dublin
Bottling Works triangle.

Took me a total of 30 minutes.

- [Narrator] As preparations continue,

word gets to Jeff that the local newspaper

has an interesting headline.

- We're not Dr Pepper anymore.

For 51 weeks a year,
it's the Dublin Citizen.

This week, they happen to
name it the Dr Pepper Citizen.

This is a little bit
disrespectful to the city

and the employees here

and the people who put their
life into this business.

We didn't choose not to do
business with Dr Pepper,

they chose not to do business with us.

We're not celebrating Dr Pepper this year,

we're celebrating the fact

that this business is still in Dublin,

employing people, supporting
the city economically,

tax revenue and all of the above, and...

If anything, it should've
stayed the Dublin Citizen.

- Well, there's some bitterness
and that's unfortunate.

I mean, we gotta move forward.

Things have happened, for whatever reason,

you can debate those all day long.

And that's unfortunate that
it's happened the way it has

but it was business from
both parties' standpoint.

Well, actually the Corporate Dr Pepper is,

they like, they wanted me to do it.

And I told them I was gonna do it

and they said that was great with them.

But they liked it, they want
to keep a presence in Dublin.

Oh, you bet they're gonna be here.

They're gonna help with a lot of stuff,

they're giving us well
over 100 cases of Dr Pepper

with pure cane sugar to give
away as prizes in the race.

- [Narrator] Turns out Dr Pepper Corporate

will be returning to
Dublin for the celebration.

They'll be handing out their own version

of pure cane sugar Dr Pepper,

a product very similar
to the Dublin original.

- Dr Pepper is gonna be
in Dublin for the party.

They're gonna walk through the soda shop

and they're gonna see,
they're gonna look around

and see if I'm selling anything Dr Pepper.

There's not a Dr Pepper product

to be found in my soda shop.

We have Dr Pepper paraphernalia

and we have awards from Dr Pepper,

that'll never go away.

But I ain't ever selling a
fucking Dr Pepper product again,

I can assure you.

It ain't happening.

we were doing here was zilch.

There was no presence at all.

All of a sudden now, you know,

they're a major participant in the thing.

- [Jeff] They're gonna be
nervous all frickin' weekend.

make for strange bedfellows.

The Dublin Lions Club

and the Dublin Economic
Development Corporation

have accepted money
from Dr Pepper Corporate

to sponsor the 10-2-4K Run.

- We're having the 10-2-4K

and that is our biggest money
maker for the Lions Club.

Very helpful, they've donated over $6,000.

Let bygones be bygones
and let's go forward.

That's what you've got to do.

And let's forget about it
and let's all work together.

- The most offensive thing about it is

that the very people who sued us

and basically this city and its heritage

are the ones who convinced
a local organization

through a couple of
dollars to sell their soul.

You would think that those organizations

who we've supported for
years by taking drinks out

to Lions Club events, by donating ice,

by donating money to the Lions Club

for years and years and
years would mean something.

My grandfather was
president of the Lions Club.

Forget years of familiar relationship,

and years of support,
all for a goddamn dollar.

Over my dead body,

when Dr Pepper doesn't
give them a dime next year,

will this race benefit
the Dublin Lions Club.

- We just need to move forward

and make this a good time for everybody

and I wish 'em success.

(dramatic music)

- The birthday celebration today,

you've got Dublin Bottling Works,

which is the main, this
whole entire city block.

Right across the street,

you got an entrepreneur
with Dublin Dr Pepper signs

selling eight ounce glass
bottles labeled Dublin,

12 ounce cans labeled Dublin

that he got from us when
we were still producing.

- We're selling what's left

of the original Dublin Dr Pepper.

We have a little bit still.

- Granted, it's his product.

It's on private property
across the street.

But it created a bad situation for us

from the perspective of the
Dr Pepper representatives

were also on the other side of the street,

handing out free cans of Dr Pepper

and some energy drinks.

The green cans, which were quite
frankly a knockoff to take.

The goodwill we had created

by maintaining sugar Dr Pepper,

with the approval of Corporate
Dr Pepper calling it Dublin,

then there were some
people who thought, well,

we'll ride off that coattail a little bit.

So you got that going on over there.

And my honest opinion of
all that is it takes away

from the celebration that is
supposed to be happening today.

- [Narrator] This year, the Dr Pepper Cake

has now become the
Triple X Root Beer Cake.

Tensions are running high

as Dr Pepper Corporate
participates in the proceedings.

- [Man] Margo picks up a
check for a chunk of change,

a bottle cap, and a case of Dr Pepper.

as the anchor, attendance
is at an all time low.

with people like all the way to the road.

- And now we have nobody.

No one wants the tasty sodas, it's sad.

- This has been one of our biggest sales.

The crowds have been fantastic.

People came to support this museum.

This time of day, it is
crawling with people.

It's not here today.

- We are down a little

but you know, there have been changes

and that's always gonna
kinda scare a few people.

If I ever find the guy that
screwed up Dublin Dr Pepper,

I will personally kick him in the balls.

- It's less people than it
has been in previous years

and I think a lot of, like,
last year when we did it,

I was swamped.

I had people from Oklahoma,
Arkansas, everywhere,

and they were supporting Dr
Pepper, Dublin Dr Pepper.

It doesn't look good right now.

I mean, with less vendors

and if they're gonna charge as much,

it just seems like it's
just gonna wilt away.

Just go away.

- Well, we just say, like
we live south of Austin

and we come up here, generally
it takes us, you know,

about a month, once a month
or something like that

and load up all the cases
and bring 'em up here

and get 'em refilled.

- I used to drink several
cases of Dr Pepper a month.

I had Dr Pepper on my desk at
work all the time constantly.

Soon as one can was empty,
I'd open another one.

- You heard the expression
a bird in the hand,

two in the bush?

And according to what it looks like,

they shot the bird and
killed the one in the bush

at the same time, so there's nothing left.

I mean, you know, it doesn't make sense.

- [Narrator] In Old Doc Soda Shop,

people are checking out the new flavors.

The soda shop is offering
an exchange program.

Bring in a can of the
Corporate Dr Pepper drink

and you can exchange it for a bottle

of one of the new Dublin flavors,

which people are taking advantage of.

- Oh, just they're doing
this that if you return,

we're getting a free one.

(mumbling)

I'm gonna tell you,

when I said take it off, you take it off.

Okay, they don't.

- [Man] Although we're on a public street

and it's legal to film anything,

that you're on a public

- [Man] I don't even

- Once they give me a can,

it's mine to do with as I choose.

And how can he tell us that we have

to drink the product that he gave us?

I mean, just because we accept the drink,

he didn't put any restrictions
you must drink this.

There's no signs out front

that say "If you take
one, you must drink it."

There was no requirement put on the drink

when they offered it.

- We're a pimple on the ass of the world

but we're apparently causing
a whole lot of hard feelings

and juvenile behavior, for that
matter, from professionals.

They wanted to pocket the money

and hope that this thing gets over with

with no attention paid
is what they hoped for.

Unfortunately, it didn't
turn out that way for 'em.
