When I got to the crime scene,

They were setting up

And speaks to the dispatcher
That took the call.

So she confirms the girl, nina,
Called from antonio's phone.

Demery: the thing
That struck me odd is that,

As I looked through
The call log,

I realized that there is
That incoming call,

But I don't see an outgoing call
To the 911 center.

My thought, for whatever reason,
Antonio deleted this number.

He felt the need to tamper
With the phone

And remove some evidence.

And started to assault her.

And at some point, mcdaniel
Told him that he had a gun.

Then scoop went towards
The trunk of his car.

I asked him where the firearm
Was and what he did with it.

I didn't necessarily buy that.

If you're acting
In self-defense legitimately,

Why would you get rid
Of a firearm?

I was hoping that,
If I left him alone,

Damien's lawyer
Would have a chance

To convince him

Now, my decision was

And I absolutely felt like
He had other options,

So I charged him with murder.

And his friend chris,

It's clear they play some sort
Of role in scoop's death,

But given
The extenuating circumstances,

I don't think
There's enough evidence

To charge them
As accomplices.

They had a court date.

Eventually, the case
Goes to grand jury,

And the grand jury believed
That,

Because of
The domestic incident,

That this was
Justifiable homicide,

That scoop was killed
In self-defense.

He never stood trial for
The second-degree-murder charge.

He was, however,
Indicted on drugs

With intent to deliver cocaine

And obstruction of justice

For his throwing away
The firearm.

He still got 20 years
In prison.

But I think
That whole self-defense story

Kind of saved him from
A second-degree-murder charge.

When you have that uncertainty
Of what actually happened here,

You run into issues of whether
You can prove your charge

Beyond a reasonable doubt,

And that was the unfortunate
Difficulty of this case.

Demery: I think this case
Is really unique.

The fact that he killed
Two people

And it was considered
Self-defense --

None of it
Makes any sense to me.

But I think
It really doesn't matter.

At least, in this instance,
He's in prison.
