You have to keep in mind
that in the late 1880’s,

the legal system
was still finding its way.

Substantial evidence
was hard to come by.

If you falsely convicted a man,
there could be hell to pay.

Much of the time,
that hell rained down on you

from the other family members.

The same could be said
if you let a guilty man go free.

No matter what the verdict was,

someone was
just not gonna be happy.

It is my job to see
that justice is served.

That’s what a judge must do.

No matter what others say,

I think I’ve done
a damn good job.

Now what goes down
outside of my courtroom,

I have no control over.

And I’m sorry, but I just
can’t lose sleep over that.

Now, I wasn’t there
on March 18, 1882,

so I’ll never be able to tell
you what actually happened.

Reports vary.
Investigations were conducted.

I can only listen
to the testimony

and work from
the facts at hand.

A man was brutally murdered.
That, there is no doubt.

Unfortunately that also tends
to happen in Tombstone.

It is the responsible party
or parties that is in question.

But as I’ve said, a judge can
only go by the facts at hand

and then he must, well,
use his best judgment.

concerning the facts

Unfortunately,
it does not provide proof

of the man or men
who pulled the trigger.

And concerning Pete Spence’s
wife, Marietta Duarte,

in regards to her testimony,

the defense is
absolutely correct.

A spouse can not testify
against her husband

under any circumstances.

Therefore, due to lack
of substantial evidence,

this court deems
that all charges

must be dropped
against the defendants.

You are free to go.
Case dismissed.

Now, I know the Earps were
not pleased by my decision,

but the law is the law.

Pete Spence was free
to go back to his ranch,

but I think he might have been
too scared to leave.

When your enemies
are the Earps,

you can be
in a heap of trouble.

And sometimes
even the law can’t protect you.

last year by Virgil Earp.

was only a suspect

in the Morgan Earp murder.

When Pete Spence was freed,

I had to free everyone else
as well.

I cannot keep a man in jail
no matter what color or creed

if I don’t have the evidence
to hold him.

So the fate of Indian Charlie
and all those around him

is not, and I repeat,
not my responsibility.

This is a bad idea.

And letting a man die
is your version of a good idea?

A man doesn’t get a wound like
this unless he’s done something.

of us want to be involved in.

employs many half-breeds

Earps have been after Frank
and Pete since last year.

shooting at the O.K. Corral?

No, but they are friends with
the McLaurys, who were there.

Since when is being friends
with someone a crime?

The Earps have had trouble
with Frank and Pete before.

Last September,
Virgil and Wyatt Earp

arrested Frank and Pete
for a stagecoach robbery.

Frank robbed a stagecoach?

No, he didn’t.

The charges were dropped
and Frank was found not guilty.

Due to several witnesses
who support

Frank Stilwell
and Pete Spence’s alibi

and insufficient evidence--

a boot print
and the word "sugar"

are not enough
for a conviction--

I hereby do declare Frank
Stilwell and Pete Spence

not guilty
of the stagecoach robbery.

- Case dismissed.
- [bangs gavel]

But two weeks later,

the Earps filed federal charges
against Frank and Pete.

Had to do with messing around
with a mail carrier.

LIZ: But I thought you said that
Frank wasn’t involved in that.

He was not,

but the Earps killed
a lot of people

and made a lot of enemies.

Wasn’t there a trial?

The Earps were not found guilty.

After considering
all the evidence and statements,

the court finds Wyatt Earp
and John "Doc" Holliday

innocent of all counts
of murder.

[banging gavel]

The judge was wrong,
and everybody knows it.

The Earps and their friends
are murderers

and must pay
for their actions.

U.S. Marshal Virgil Earp
has stated for the record

that both Wyatt and Doc Holliday
where deputized on October 26th.

Therefore these men were acting
within the letter of the law

and hereby are free
of all charges.

- Case dismissed.
- [bangs gavel]

They’re looking
for someone to blame.

I think any man who’s been
arrested numerous times

isn’t completely innocent.

The Earps, too,
were arrested for murder.

They’re U.S. marshals.
They got the law on their side.

Do you know how many men
have hidden behind the law

to commit horrible crimes
and then get away with it?

black and white as they seem.

no other means

by the legal system.

Revenge is frowned down upon.

However, if you find that you
or your loved ones

are in immediate danger,

then sometimes self-defense
is the only way to go.

what exactly happened

on the evening of March 21st
at the Tucson Railroad,

except a man was killed.

That’s a fact.

However, the motivation
that led to that event

is in question.

I can tell you this.

When a lawman
hides behind the law

and commits
a questionable act,

it opens up a whole can of worms
and makes my job much harder.

What Wyatt Earp and Doc Holliday
did that night

might be justified
in their own minds,

but it cannot be overlooked
by the law.

A trial should have occurred.
It did not.

which resulted in Frank
shooting Bega through the chest

and killing him.

Frank was acquitted
on grounds of self-defense.

Then two years later,

Frank was working in a mine
in Mojave County,

and he had some sort of argument
over claim-jumping

with a Colonel John Van Houten.

Frank resolved that argument
by taking a rock

and bashing that man’s head in
until he was dead.

Frank was charged with murder,

but he escaped
a grand jury indictment

on the grounds of
lack of evidence.

Now, in April,

Frank was hired as an assistant
deputy by Sheriff Beham.

Four months later,
he was fired.

Let me see if I can remember
the term that they used?

I believe it was
"accounting irregularities."

Soon after that,

a stagecoach was robbed
by two masked men.

They took
all the passengers’ valuables

and a strongbox
with just over $2,400 in it.

But if you say
they were wearing masks,

then how do you know
that Frank had anything to do

with those robberies?

DOC: Wyatt and Virgil
tracked the bandits

from scene of the holdup,

and they discovered
a custom boot print.

When they went
to a shoe repair shop

that’s known for providing
extra-wide heels,

and they linked that print
to good ol’ Frank Stilwell.

Let’s not forget three nights
ago when he was involved

in the shooting of Morgan Earp
in the back

while he was playing pool.

And what about you,

I wasn’t there.

that you knifed
