- Rhode island, literally,
is the ocean state.

- You grow up
just knowing the ocean.

I mean,
the ocean is part of you.

- But just because
of the geography--

[thunder booming]

--You get a good storm,
you're gonna get flooding here.

- The city suffered from
what's called a macroburst.

- It's basically
a really big thunderstorm.

The wind basically blows
everything sideways.

- Boats got untied
and thrown into bays

All over the coastline.

It was bad.

- The next day, I saw a boat
that I hadn't recognized.

I couldn't believe it.

I found a body, a human body.

- I just dropped.

The big question is how?

Was it a boat
accident in the storm?

- The eyewitness said
two subjects had a cooler

And a gas can and
proceeded down to the boat.

- There was a figure
standing on the deck driving

The boat down the coast.

- I was thinking we actually
had a homicide at that point.

[tense music]

[seagulls squawking]

- Known as the city
by the bay,

Warwick, rhode island,
is truly all about the water.

Home to 18 marinas,
3,200 boat slips--

That's a lot of slips--

And approximately 39
miles of scenic coastline,

The historic beach town
offers endless opportunities

For fun in the sun.

But after a devastating
storm rips through the area,

An abandoned boat
reveals a dark secret.

And one family
is swept up in tragedy.

[tense music]

[thunder booming]

- On August 4, 2015,
the city of warwick

And the majority
of rhode island

Suffered from what's
called a macroburst.

♪ ♪

- The wind comes
down and basically

Blows everything sideways.

♪ ♪

It went right through the bay.

It just caused havoc
in and around all

The marinas and the waterways.

- The intensity, you know,
the violence of the storm

Brought with it a lot of wind.

- It tore up
people's property.

Boats got untied
and thrown into bays

All over the coastline.

♪ ♪

I mean, it was bad.

- Often occurring
during a thunderstorm,

A macroburst is an
intense downdraft

Of air that spreads
out in all directions

When it hits the ground.

Wind speeds can reach
100 miles an hour,

Causing structural damage
to buildings and loose debris

To become airborne missiles.

They're comparable to,
and in many cases,

Can be worse than tornadoes.

[sirens wailing]

- The warwick fire department
and police department

Was on just about
every street corner

Taking care of downed wires,

Taking care
of downed tree lines.

[sirens wailing]

- There were power
outages all over the city.

So from a police
perspective,

We were trying to handle
traffic,

Trying to handle
emergency calls

All around all the damage
that was done

By this macroburst.

[tense music]

♪ ♪

[birds chirping]

- After the macroburst, it was
important to check on things.

[light piano music]

Harbormasters are in
charge of boating safety.

So we needed to check
if anything happened.

Damaged boats,
boats ashore or sunk,

We'd respond to it as needed.

Normally, the same boats are
in that area all the time.

But I saw a boat
that I hadn't recognized.

♪ ♪

- The vessel in question,
the "star capella,"

Is a columbia 26
yellow-and-white sailboat.

Built in the late 1960s,
it's known for its speed

And stability
and is excellent for extended

Stays on the water.

♪ ♪

- I assumed that it had come in
to get away from the weather.

♪ ♪

So I watched it for a while,
then I realized it was moving,

Kind of floating out there up
against another person's boat,

Causing some damage.

♪ ♪

So I drove to one
of my patrol boats

And made my way over to it.

♪ ♪

I was able to get
on board the boat.

Didn't hear anybody,
didn't see anybody.

I spent very little
time on the boat.

It wasn't locked.

Just looked inside quickly.

Most of the
contents of the boat

Were strewn about on the floor.

What a mess.

So I thought maybe
the person living on the boat

Had been out in the
storm and maybe things

Got a little out of hand
and decided to get away

From it as soon as he could.

So I decided to tow it to
the mouth of warwick cove

And put it on a mooring where
it would be in plain sight

From a number
of locations in case

That person were to return.

♪ ♪

Then I waited.

♪ ♪

- A mooring is a
floating buoy that

Is secured to the sea floor
with something more permanent

Than an anchor.

It has been set by experts
or government officials

And is intended
to be there long-term.

In this case,
because the harbormaster

Didn't know who owned the boat
and where it should be docked,

It was the best solution
for securing the vessel

Until the owner returned.

♪ ♪

- I thought the boat was going
to be picked up and taken away.

But a little more
than a week--

Actually, it was 11 days--

And I saw the boat.

So I went back to check
on the boat more closely.

And I realized that there was a
foul odor coming from the boat.

Obviously didn't know
what to think of this,

If something had
gotten into the boat,

Whether it was a bird or an
animal or something like that.

So I then boarded the boat,

Went inside, and there was
considerable insect activity.

♪ ♪

I took a boat hook.

I started lifting
and moving some

Of the debris that was on the
deck or the floor of the boat.

♪ ♪

I saw the feet and legs first.

♪ ♪

I couldn't believe it.

I found a body, a human body.

♪ ♪

The body's state was so
advanced in decomposition.

I had never seen anything
like that in warwick before.

It's not something that
I ever expected to find.

My mind, it's--
it's spinning at this point.

How could this have happened?

I said, well, maybe he'd
been out in the storm.

[waves crashing]

Fell, hit his head,
or something like that.

I guess this body had to
have been here all along.

And that was a pretty shocking
feeling, sickening feeling.

And at that point, I left
and made a couple of calls

To both fire
and police to determine

If this was a matter
of criminal activity

Or an accident on board a boat.

♪ ♪

- We were attempting to
determine who the owner was.

[thunder booming]

It appeared that the
person had stumbled

On the back of the boat.

But with the advanced
state of decomposition,

It was hard to determine
the means of death.

- There may have been
a couple of individuals

Seen on the boat
that piqued our curiosity.

- There's always a
possibility that the death

Had been the result
of foul play.

♪ ♪

[tense music]

- 11 days after a destructive
macroburst hits warwick,

Rhode island, the harbormaster
discovers a body

Inside an abandoned sailboat

And immediately
contacts authorities.

♪ ♪

- We got there to the scene
and could see

The 26-foot yellow boat
that was in question.

We didn't think it
was gonna be anything more

Than possibly
an elderly person

Enjoying their days on a boat.

And unfortunately,
at that time,

Nobody had noticed
them for a little bit.

As we boarded the boat, we
noticed a strong odor coming

From the inside of that boat.

♪ ♪

- The contents of the boat
had been tossed around.

♪ ♪

And the body had been
concealed in the cabin.

♪ ♪

- It appeared that the
person had stumbled

And fell
in the back of the boat.

The body was covered
with a foam mattress.

After the mattress
was removed,

Decomposition
was so advanced,

It was very difficult
to determine

Whether or not the decedent was
male or female, young or old.

You couldn't even tell
the race of the person

Or what the means
of death could be.

[seagulls squawking]

- It's the peak
of humid summer,

And it's an aquatic environment
with extreme moisture.

That, coupled with the
size of the vessel,

Create an almost
greenhouse-like effect,

Causing the body to
decompose at a rapid rate.

♪ ♪

- At that point, the body
was taken into custody

By the medical examiner's
office that began

An investigation
into the cause of death.

♪ ♪

I then went down and
questioned the harbormaster,

And harbormaster barris
was reporting to us

That he knows that that
boat was stationary

For over a week's time.

We were attempting to
determine who the owner was

To see if we could
get any information

On who should be on the boat.

We were able to find documents
on the boat for a gentleman

Named fernando silva.

♪ ♪

We felt like we were
definitely on the right track

That he owned the boat.

Next, we were able to
look through records

And find out information
on family members

Who were local to the area.

♪ ♪

- Upon speaking with
family members regarding

The whereabouts of mr. Silva,

They advised
that approximately

A week and a half prior, they
had made several attempts

Via his cell phone
but was unable to make

Contact with mr. Silva.

- We said to detectives
that three days before

The big storm came in,
my brother, fredy,

Promised his son, kenny,

That he was going
to help him paint his house.

♪ ♪

Kenny was very close to fredy
and was always around him.

So kenny waited like an hour.

He said, I waited,
and I finally realized,

Well, he's not gonna come.

But we didn't worry too much,

Because he was always
out there sailing,

Doing something.

And so sometimes you don't
hear from him for a long time.

He did have a cell phone,
but you

Don't always have cell phone
service out in the ocean.

We knew eventually,
he would always, you know,

Get in touch with us.

But then after this
big storm came through

And we hadn't heard anything
from him in a while,

Now you're starting to feel
your heart pump a little bit,

And you're starting to worry.

♪ ♪

Everybody was calling
everybody,

And they're all going,
no, we haven't heard from him.

No, I haven't seen him.

Now the alerts go up
a little bit.

He's never gone this long
not contacting people.

- We felt pretty
positive at that point

That mr. Silva was the person
that was deceased on the boat.

♪ ♪

But we knew that the
medical examiner's

Office would have to confirm
the identity of the body.

♪ ♪

We were able to confirm with
the medical examiner's office

Through the dna
that it was mr. Silva.

♪ ♪

But with the advanced
state of decomposition,

It was hard to determine
the means of death.

They were actually
gonna have to send

Testing out
and get the assistance

Of a forensic anthropologist.

♪ ♪

- And that's when the
detectives call my daughter.

I was home alone.

When my daughter got there,
she had just kind of come in.

She goes, uncle fredy.

Mom, he's dead.

♪ ♪

And I just dropped.

And the next thing
I know, they're like,

Lifting me up and--
and putting me on the couch.

[somber piano music]

I knew he was missing.

I knew we were
asking about him.

But it's an unexpected
thing to a person.

That was, like, heart-wrenching
for me, for all of us.

♪ ♪

My brother, fredy,
had a quirky sense of humor

And was very
jovial, gregarious.

♪ ♪

I'm ten years younger
than he, and he never,

Ever made me feel like
I was a tagalong or anything.

- He was a great brother.

He was great with dolly.

He loved her.

He adored her.

- I always remember
him as involving

Me in what he was doing.

And he was very much into
two things, boats and cars.

[tense music]

- As editor of a local
newspaper, I got to know

And made friends
with captain fredy.

♪ ♪

He sold his car for 500
bucks, to my recollection,

And bought this sailboat.

I don't believe it even had
an engine, was lacking sails,

Didn't have a boom.

- He was lucky enough to find
this boat in that condition,

And he repaired it
and got it all up and going.

And then he named
the "star capella."

♪ ♪

He always told me,
there's nothing like it,

Looking up into the sky
and seeing all the stars

And the constellations.

♪ ♪

He lived the life
of a sailor on the ocean.

He just loved that life.

♪ ♪

At this point, the police
are looking into it,

But we don't know
what happened.

We just knew he died.

The big question is how?

♪ ♪

Was it a boat
accident in the storm?

Did he have a heart
attack and just die before

Even the storm happened?

It was a mystery.

And we want an answer.

♪ ♪

[tense music]

- It's been two days since
captain fredy's body was

Discovered, but due to
extreme decomposition,

Police are still waiting
on autopsy results

From the medical examiner
and forensic anthropologist

To determine whether his death
was a result of the storm

Or something else.

♪ ♪

- In many investigations
that we've had before,

We were able
to go up to a scene

And see an obvious cause
for the person that is

Deceased there.

In this case,
it was different.

We had to wait an
extended period of time

For the medical
examiner's office

To determine whether or
not mr. Silva's death

Was a result
of the macroburst.

♪ ♪

We very easily could have
just sided with mother nature

And sided with the fact that
he was an elderly gentleman.

But there's always
a possibility

That mr. Silva's death had
been the result of foul play.

So we couldn't leave any
leaves unturned at that point.

♪ ♪

So while waiting for the
medical examiner's office,

We responded to
warwick cove in an attempt

To speak with anybody that
might have had knowledge

About
captain fredy's whereabouts

Over the previous couple weeks.

We were able to speak
with a gentleman

Named steven emerson, who was
also residing at the marina.

♪ ♪

Steven emerson
did remember the boat

And did remember a fernando
silva living on that boat.

He informed us that mr. Silva
had made prior arrangements

With ducky waterman to be
able to place his boat there

At a private dock.

♪ ♪

Ducky waterman's name was
a familiar name to us,

And we had had several prior
contacts with that subject.

♪ ♪

- Ducky was a local that was
about town, sort of a drifter.

- Most of the people that had
resided in the waterman house

Were transient, which
required neighbors summoning

The police
to his address several times

Over my 20-year career.

♪ ♪

We asked mr. Emerson
if he had seen anything out

Of the ordinary with the boat
or any other strange characters

Coming around to visit
mr. Silva at the boat.

And he remembered
that on August 1st

He heard a loud pickup truck
idling near his residence.

And then he saw two people exit
and walk down towards fernando

Silva's boat through his yard.

He exited his house and
approached them and asked them

What they were doing there.

They stated that they were
enlisted by a ducky waterman

In order to help out
fernando silva

Due to having
boat motor problems.

♪ ♪

- The fact that there
may have been a couple

Individuals seen
on the boat in early August,

That piqued our curiosity.

And where was
fredy silva at that time?

- Mr. Emerson stated
that while speaking

With the two males,

He asked why
mr. Silva wasn't around.

And the two males stated
that they believed he

Was out playing keno lottery.

Mr. Emerson remembered
that the two subjects

Were carrying a cooler,
some gas, and what

Appeared to be a motor.

And he believed that
approximately 30 minutes later,

The two subjects
were seen leaving.

♪ ♪

But he stated that he did
not recognize any of them.

♪ ♪

However,
he was able to give us

A very good description of the
vehicle parked at the marina.

It was a maroon
dodge ram pickup truck.

♪ ♪

- We wanted to see if we
could respond to ducky's house

And confirm the existence
of these two other people

To more confirm
mr. Emerson's story

And then ultimately make
contact with the people that

Boarded the boat.

But on our way
to that location,

We received a call
from the medical examiner.

Ultimately,
they were able to confirm

Mr. Silva had a broken bone
in his neck, the hyoid bone.

This was due to strangulation
and not from the macroburst.

♪ ♪

Also, the medical examiner
said that it was possible

That mr. Silva was stabbed.

♪ ♪

Now, we could say beyond
a reasonable doubt

That we actually had
a homicide on our hands.

♪ ♪

[tense music]

♪ ♪

- On the way to the
waterman residence,

Police learned
from the medical examiner

That fredy silva was murdered.

Now, it's imperative
detectives speak

With ducky waterman
about the two men

He hired to repair
fredy's boat.

♪ ♪

- We arrived at the
waterman household

And saw a male,
who we knew as ducky,

Standing in the front
yard of the residence.

♪ ♪

Ducky waterman
voluntarily came back

With us to the police station.

- Ducky informed us that he
knew that mr. Silva was having

Motor problems with the boat,
and approximately a couple

Of days prior, had won it big,
from what he says, in keno.

- Then ducky said one
of the two subjects that

Went down
to the boat was a subject

By the name of troy gunderway.

He said he didn't know
the other gentleman.

Troy, as he stated,
was a white male

With a tattoo on his head

And was currently
helping his brother

Install a fence
in the next neighborhood.

♪ ♪

We immediately
went to the backyard,

And upon talking
with mr. Gunderway

About his whereabouts

Over the previous
couple of weeks,

He openly admitted that
he was requested to assist

With getting a boat motor
fixed on a sailboat that was

In warwick cove marina
for an older gentleman,

Possibly by the name of fredy.

We asked troy if he had
anybody that was with him.

He confirmed that it was a
subject by the name of

Richard baribault.

He stated that
himself and richard baribault

Had gone down to the boat to
attempt to start the new motor,

But mr. Silva wasn't around.

And then we asked him
if richard baribault

Had a vehicle that he owned,
and he stated that,

Yes, he owns a maroon
dodge ram pickup truck.

♪ ♪

This information received
from mr. Gunderway just

Heightened and approved
the information

That we got from mr. Emerson.

So we felt like we were
definitely on the right track.

We know from mr. Emerson
that these two people

Definitely entered that boat.

But we weren't sure if that
was prior to mr. Silva's death

Or after mr. Silva's death.

We felt that the best
thing to do at that point

Would be to question
mr. Baribault.

♪ ♪

So we asked troy if he could
tell us where richard lived.

He gave us a little
information that he lived

In warwick
over by the warwick mall.

We responded to
the area, and we

Were able to locate a red,
maroon dodge ram pickup truck.

Not knowing if it
belonged to richard,

We were able to run
the registration plates,

And the registration
plates were

Reported stolen
out of a neighboring

Community of west warwick.

♪ ♪

That was definitely
a great starting point.

Instinctively, we thought
maybe he did something

Nefarious to mr. Silva.

♪ ♪

After confirming that the
registration plates

Were indeed stolen,
we decided to complete

Surveillance on the area.

After waiting
approximately three hours,

We saw a subject who we
believed to be richard enter

The driver's side
of the vehicle

And drive away
from the residence.

♪ ♪

We waited for the vehicle
to enter the roadway

And performed
a motor vehicle stop.

[siren chirps]

We were able to speak with
the operator, who identified

Himself as richard baribault.

We informed him
of the reason of the stop

And that the registration
plates were stolen.

In the state
of rhode island,

Possession of stolen
motor vehicle plates

Is a misdemeanor charge.

So at that point,
we had probable cause

To place mr. Baribault under
arrest for that larceny charge.

♪ ♪

While doing a pat-down,
we also located a knife,

Which was over 3 inches.

And in the state
of rhode island,

That is also
a misdemeanor charge.

He was placed into custody
for the stolen registration

Plates and
possession of a knife

With a blade over 3 inches.

We looked closely inside
the protective sleeve

Of the folding knife.

You could see what
appeared to be dried blood.

♪ ♪

During the autopsy,
the medical examiner

Explained to us that
mr. Silva had stab wounds.

Maybe mr. Baribault
still had what

We believed to be
the murder weapon

With mr. Silva's blood on it.

So we needed to question
mr. Baribault about the blood

On the knife and his
whereabouts on August 1st.

♪ ♪

[tense music]

- When warwick police pick up
richard baribault, a person

Of interest in
captain fredy's murder,

They recover a bloody knife.

Now, they need to interview
baribault and find out if he

Was involved in the homicide.

- We took the knife
into evidence,

And then we brought him
up to the detective room.

- We were hoping while
interviewing mr. Baribault

For the possession of
stolen registration plates,

For the possession of a knife
with the blade over 3 inches,

We're able to segue
into his whereabouts

On the nights in question
with mr. Gunderway.

- We began asking
him questions,

And he openly admitted
that on August 1st

He was, in fact,
with troy gunderway.

In this case,
richard's story was very

Different than what troy said.

- Richard said he heard that
mr. Silva had won about $800

In keno because he was bragging
and buying people beverages

At the local establishment.

- For fredy, it was a simple
pleasure to have a beer

And play keno because
it wasn't very expensive.

- They win a few bucks
and buy a few beers

And maybe a few cigarettes,
too, and that kept him happy.

But then, maybe two days before
the storm, he hit it big,

Way beyond
what he had won before.

- Richard said that
it was at that point

That troy gunderway
had devised a plan

To possibly go rob mr. Silva.

- Richard baribault indicated
that they had been on the boat

And that an assault
had taken place.

♪ ♪

- Police have two suspects who
admit to being with captain

Fredy on the night
of his murder,

But they both deny killing him.

Detectives now need
physical evidence

To get a clearer picture
of what happened that night.

And they know that docks
full of expensive boats

And equipment
are generally monitored

By surveillance systems.

- We knew fredy silva
had been killed

On or around August 1st.

At that point in time,
I had probably about close

To 15 years' experience
in collecting video evidence

In and around the city.

In that amount of time,
I've come to learn

Where a lot of the
exterior cameras are held.

The first place I tried
to get any video evidence

Was from warwick cove marina.

That marina was right
next to the dock

That the "star capella"
was allegedly

Docked on and around
August 1st.

We first looked at the camera
looking down mohawk avenue

And found that on August 1st

A truck matching
richard baribault's

Was leaving the marina
in the early morning hours.

At this point, we need
to try to find angles

Of video cameras
that may have captured

The dock where the boat
was said to be on August 1st.

Unfortunately,
that system had overwritten

And did not have any
recordings prior to August 2nd.

♪ ♪

Any chance that we had
of actually seeing baribault

Or gunderway walking down
the dock, going to the boat,

Coming from there or any
assault take place was missing.

♪ ♪

But we did have everything
from August 2nd

Until August 20th.

And from there, we were able
to analyze over 26,000

Video files,
one angle of which captured

The "star capella"
in the distance on August 4th

Sailing east up the cove.

There was a figure
on the boat.

You couldn't tell
if it was male or female.

You could just tell
it was a single person

Standing on the deck, driving
the boat down the coast.

We compared that
with other camera views.

Every time somebody
was on the boat,

Baribault's truck had come
and gone from the marina.

Looking at the video,
we also could

Tell the truck was there 12
to 13 times from August 1st

To August 4th.

But then again, we can't
tell due to the resolution

If that's gunderway
or baribault.

So we decided
to get mr. Gunderway

And question him about his
interactions on the boat

With richard baribault.

We informed him that there was
some concerning facts

That mr. Baribault
had brought up to us,

Which we wanted his information
and knowledge of those times

To be explained to us.

- Troy confirmed that he was
with mr. Baribault

At that time.

He confirmed that he did
go down to that dock,

But, of course,
his recollection

Of the incident was slightly
different than richard's.

- Troy insisted that it
was baribault's decision

To rob mr. Silva
and that he was

The unfortunate person that had
just gone along for the ride.

But after we had presented
mr. Gunderway with the fact

That we could seize
all electronic devices,

Retrieve gps coordinates, and
with the eyewitness testimony

That put them down at the boat,
mr. Gunderway immediately said,

"I'm gonna tell you
exactly what happened."

♪ ♪

- When police present suspect
troy gunderway with evidence

Tying him to
fredy silva's murder,

He begins revealing
details from that night

And placing the blame on his
accomplice, richard baribault.

[tense music]

- Troy gunderway stated that
himself and richard baribault

Had gone down to the boat
to rob mr. Silva

Of his keno winnings.

♪ ♪

Richard had entered
the boat first.

♪ ♪

And when he had
entered the boat,

He startled mr. Silva,
who woke up and began

Yelling at the two of them.

♪ ♪

He said,
at that time, mr. Baribault

Had punched
on mr. Silva approximately

Five times about his face.

And at that point,
mr. Baribault

Had taken out
a knife that he had brought,

And he was sticking it up
against his side and neck area.

♪ ♪

The knife that we had found,
we had discovered

Dried blood on it.

We figured it was probably
mr. Silva's blood.

Troy said that they weren't
able to locate the keno

Winnings and that they very
quickly had left the boat

But that they had gone
back and forth to the dock

And boarded the "star capella"
several times.

- And he acknowledged
to moving the boat

To get rid of the evidence
that they felt would

Convict them of this crime.

On August 1st,
they never called the police.

They never asked for help.

All they wanted to do
was get rid of the evidence.

- Then on August 4th,
the storm came through,

Went right through the bay.

So they had an idea.

- They ultimately
moved the boat

So that it appeared
mr. Silva had possibly

Stumbled and fell
in the back of the boat

As a result of the macroburst.

So you have the fact
that two people admit

To being on the boat,
to forcibly touching him,

And the commission
of a robbery that ultimately

Led to mr. Silva's death.

♪ ♪

So we placed both
subjects under arrest

For the murder of mr. Silva.

♪ ♪

Immediately after,
troy gunderway

Wanted to take a plea deal
for second-degree murder

And conspiracy.

♪ ♪

- At the time of the arrest

And apprehension
of these guys,

Detectives needed us in there
to approve the plea deal.

We were all like, no.

Like-- like,
he took our loved one.

We're not gonna
have my brother.

But they explained to us very
nicely that without this guy,

The other one could go free,

Because we don't have enough
to make sure

This guy is convicted.

And we said, ok, because
we want to make sure they

Both pay for what they did.

♪ ♪

- Despite all the evidence
that we had gathered,

Richard baribault continued
to say that he was not guilty.

- We felt that it was
very important to prove

That mr. Baribault returned
to the scene of the crime

Several times
to get rid of the evidence.

In an investigation,
video surveillance

And gps coordinates
are absolutely fantastic.

When you bring them to court,
juries really do love them.

So we decided to do a search
warrant for their cell phones

And their google accounts.

- When we got the
google history back

For baribault's phone, there
were searches during the dates

And times in question
in early August

That he had made
in his own voice.

- When you take all that
and put that all together,

It's obviously
very incriminating.

♪ ♪

- Richard baribault
ended up going to trial.

- Troy gunderway was the star
witness for the prosecution.

[gavel banging]

We felt that we
had a strong case,

And we wanted to just make
sure that the jury knew

Both were voluntarily there.

Both admitted to being
involved in the robbery,

Which ultimately led to the
death of fernando silva.

And we were able to prove
