the whole investigation.

Your mind takes you
to some dark, scary places.

Was he laying there on the
ground with bullets in his head?

Nobody will ever know what he
went through on that cold floor.

Coming up, code 131.

Within minutes,
officers arrive on the scene.

I pulled up to the scene.

I turned my body cam on,
and I was going through my head

what scenarios
were going to play out.

Everybody is on high alert.

Bellaire police chief
Michael kovalyk takes the lead.

Someone finding a dead body in a
residence in the west bellaire

area was something that...
The last thing we would expect.

It's wondering what could have
brought this about.

It was kind of a shock to find
out it was Brad mcgarry.

I knew him.

This guy was a very nice guy.

The victim was facedown
with what appeared to be

a gunshot wound to the head.

Of course, there was quite
an amount of blood on the floor,

but we didn't figure
it had been over 5 or 6 hours

since he had been shot.

There was no signs
of any struggle of any sort.

When we find someone
that had been shot in the head,

we consider
a possibility of suicide.

Looking for answers,
investigators turn to the people

who discovered Brad dead.

The people outside
are David Kinney and his wife,

cheri,
the woman who called 911.

We had to start
with the kinneys.

They're the ones that said
they had found Mr. Mcgarry.

They were our star witnesses.

It was locked, and no one
came to the door.

Kinney said he then
told his daughter

to go up behind
to the back door of the house.

She found the door open.

He saw Brad, and Brad
had obviously been shot

and was deceased.

He became very devastated.

Word of Brad's death
quickly filters out

to his family and friends.

The day I found out
that Brad was dead,

I was at work that day,

and I got a call
from our mutual friend.

It was surreal and is something
that happens on TV and movies.

It's not something
that happens in real life.

Brad was a big Teddy bear,
just a loving, cuddly guy.

Brad was uncle Brad to my kids.

He loved my kids.

He just was so creative and had
a good heart and loved people.

My mom told me,
and I fell to the floor.

I was just crying.
I couldn't get myself together.

I just felt like my soul had,
like, left my body.

Brad meant the world to me.

He was just someone
that I could count on

to make me laugh or make me
smile or just whatever I needed.

He was there.

One of Brad mcgarry's closest
friends was David Kinney,

the man who found
Brad's lifeless body.

It is horrific for them to come
up on such a scene like that.

It was too much for them
to handle.

You can never get used to it.

David Kinney showed
a great deal of emotion.

He expressed disbelief
that his friend was gone.

Yeah.

Yeah.

Suspecting suicide,
investigators question

the kinneys
about Brad's personal life.

He's not too bad.

While investigators speak with
David and cheri Kinney outside,

inside officers pore
over the crime scene

looking for the gun Brad might
have used to kill himself.

One of the primary concerns
of the crime-scene search

we're definitely wanting to find
is the weapon used.

In a lot of suicides,

you'll see the victim fall
on top of the weapon

where the weapon
ends up underneath them.

We moved the body around to do
a search underneath the firearm.

We did not find one.

We have a gunshot victim
and no gun.

Somebody took the gun somewhere.

You're dealing with a homicide.

We have a killer
that is out there,

and we don't know
what their motivation is.

We don't know if this
is a spree killer,

a serial killer, or someone
that's going to kill again.

The hunt for who killed
Brad mcgarry was on.

Beloved friend and coal miner

Brad mcgarry has been found
shot dead

in the basement
of his bellaire, Ohio, home,

and with no gun
found at the scene,

investigators now realize

they have a murder
on their hands.

At this point
in the investigation,

we don't know a lot,

but we have a killer
that is out there,

and we don't know
what their motivation is.

Investigators continue
their search of Brad's house

looking for anything that might
lead them to their killer.

We started going through
the upstairs and the bedroom.

All the drawers were pulled out
and the dressers.

The place was pretty much
throwed about,

things thrown here,
there and everywhere.

Brad collected what was
referred as country art,

kind of things you'd see at
a cracker barrel country store.

He had a great deal of it.

But when investigators
take a closer look

at the crime scene,
questions arise.

You know, there's cash money

and brand-new smartphones
laying around.

There's cameras still in boxes.

There's nice tvs.

These are all things
I would expect to not be there

in a burglary
or robbery-type situation.

We didn't know exactly
what we were dealing with.

Things weren't adding up
100 percent.

If burglary wasn't the motive
for this murder, then what was?

At this point,
detectives aren't sure.

A canvass of the area was done,

and one of the questions
that we asked

was if we got
any surveillance video.

It could really help US narrow
down our search for a suspect.

We're double, triple-checking
some of the stories

we've been getting from
some of the witnesses.

They discover Brad's neighbor

had his video-surveillance
system

rolling on the day
of the murder.

It was very exciting to hear.

We can use that footage
to nail down

what time Brad returned home,

what his travels were,
what his habits were.

That'll help US get to know
Brad better,

but you're looking at
a very time-intensive period

of going over hours and hours
and hours of recorded video

trying to figure out
what's relevant or not relevant.

Back outside Brad's house,

chief kovalyk looks for answers
by continuing to press

cheri and David Kinney.

He...

Yeah.

Yeah.

Brad was a gay man,
and David and cheri Kinney

had told US about
a recent ex-boyfriend of Brad's

who had the first name of Scotty

that there had been some
friction and problems with,

but the kinneys didn't know
Scotty's last name,

so that's something that
we definitely had to find out,

and as he was leaving,
David Kinney,

you know, put out his hand
and grabbed my hand,

and he squeezed it very tight,

and he looked at me
right in the eye and said,

"Brad was the best friend
I had in the whole world.

I loved him. Please find out
who did this to my friend,"

and I told him that we would do

everything we could
to make that happen.

While the kinneys grieve,
the next day,

the results
of the autopsy come in.

Brad was killed by two gunshots

from a .22-caliber handgun
to the back of the head.

Finding out that Brad
had been killed was one thing.

Finding out the manner
that he had been killed

was an entirely different thing.

I just couldn't comprehend
the concept

of somebody
purposely harming him.

I couldn't understand
that at all.

It's definitely a punch
in the stomach to find that out.

I couldn't breathe.

With any type
of death investigation

and especially
a homicide investigation,

there's a dark energy,

definitely runs
through the entire department.

It's a good motivation
for everybody to get up

and do everything they can.

Investigators start their search
for a suspect

by questioning the people
who knew Brad best:

His friends and family.

Chief allar starts with
Mary Kay milliken.

But...

Then Mary Kay mentions
something else,

a detail that matches
an earlier theory investigators

had already been pursuing.

Did investigators abandon

their botched-burglary
theory too soon?

It's something that we got to
keep in the back of our heads.

Could this homicide have been
the by-product of a robbery?

You know, maybe Brad come home
and spooked a burglar

and was shot
to cover up the crime.

Detectives
investigating the murder

of Brad mcgarry
in bellaire, Ohio,

wonder if he was killed
during a burglary gone wrong.

We thought that maybe
it was a burglary,

and it went bad,

and whoever it was panicked
and murdered Mr. Mcgarry.

Investigators
return to the crime scene

looking for evidence
to confirm their theory.

You're doing due diligence
on any case

in pursuing
any possible factor

what could've led
to Brad's death.

The crime scene itself
presents a mystery,

and investigators aren't sure
how to interpret the evidence.

You have a homicide.

You got a ransacked house.

It's pointing this way,
but it's not feeling that way.

You walk into any scene.

These places have feels,
you know,

and nobody was feeling
this as a robbery,

but that's what it wanted
you to think.

Each one of the drawers
in all the areas

looked like they were pulled out
to the same point

if you would or same distance.

That struck US as being
somewhat odd.

It was a rushed job,
it was sloppy,

and it definitely started to
feel like a staged crime scene.

It was made to look like
something that it wasn't,

so if this was
a staged crime scene,

this was not a burglary
or a robbery.

We got to start asking questions
of who benefits

or who would've been
in the best position

to have something to do
with his death.

Investigators have
a possible suspect,

but his identity remains
a partial mystery.

We definitely felt like finding
Scotty could help US

to find the missing
piece of that puzzle,

so of course we wanted
to find him, see what he knew,

if he knew anything
that was going to help US

to solve this case.

We're interested in finding
this Scotty,

at this point,
last name unknown,

and we don't have
a lot to go on.

Detectives continue looking
for answers by tracking down

and speaking
with Brad's friends.

Boom, we got a name:
Scotty Butler.

Finally, detectives have
the remaining piece

of this
investigative puzzle.

This was very exciting.

It's like Christmas morning.

Now we could find him
and talk to him.

Police dig into
Scotty's background.

They discover a criminal record
and a location.

We discovered he was in fact
in jail in West Virginia

for a parole violation.

We talked to Scotty Butler.

He seemed to be surprised and
very upset that Brad had passed.

He had no idea who would want to
do anything like this to Brad,

didn't seem to have,

you know, any reason
to have him killed either.

We were fairly confident
to rule him out as a suspect.

It was time to stop wasting time
on that train of thought.

We documented what we did
with him and moved on.

Days into the investigation
and detectives are no closer

to catching
Brad mcgarry's killer.

I did want to know
who did this to him.

I felt very angry and frustrated

because I couldn't
figure it out myself,

and I wasn't in control
of the situation.

It's hard to understand

why someone would take
someone else's life,

and the next thing
that goes through your mind is,

"did he suffer? Was he laying
there on the ground

with bullets in his head?
Did he bleed to death?"

And your mind takes you
to some dark, scary places.

But just as the investigation
begins to stall,

detectives receive word
that what they feared

the most may have come true.

Seventy-eight-three-five,
code six, 25 north...

There's been another shooting

just minutes away
from Brad's home.

Two days after Brad's murder,
there was another shooting

that occurred
just across the county line.

We didn't know
what was going on.

Did he kill again?

Just 2 days after Brad mcgarry
was shot dead in his own home,

there's been a second shooting

just a few miles away
in wheeling, West Virginia.

Now detectives wonder
if the two cases are related.

You kind of got a stopwatch
going off in your head

that you want to race
against the clock,

at the same time
not trip and fall,

and that's a hard thing to do.

Officers at the scene
discover the victim,

identified as 41-year-old
ahmid hinton, barely alive.

While their squad-car
dashcams record,

first responders struggle

to keep hinton from death.

Emts race hinton
to the hospital,

but he dies en route.

A murder investigation
is underway in wheeling.

It's our top story
live at 5.

A man shot several times
on wheeling island,

now a manhunt underway.

Detectives learn that,
just minutes before he died,

hinton identified his killer:
A man named Jordan Davis.

But can bellaire investigators

link Davis
to Brad mcgarry's murder?

It's not the sort of thing
that happens

on a regular basis
in this area,

and you get two
violent gun incidents

that occurs
at the same time.

We need to look at that.

I reached out to the department
handling it

and very quickly
compared notes.

This is the type of case I have.

These are the players
that I have.

What do you got? Is there any
connection between the two?

Chief allar learns that

wheeling police obtain
surveillance video

from a neighbor
near the crime scene.

You're looking at
surveillance video

of a gun fight outside
of a residence

in the wheeling area.

The video captures ahmid hinton
collapsing outside the house

of an acquaintance
after being shot.

The acquaintance
then returns fire,

but the shooter gets away.

Investigators know
Brad was killed

with a .22-caliber gun,
so they compare the ballistics

to the weapon
used to kill hinton.

One thing that you're
looking out for

is weapons, calibers,
and it wasn't a .22.

That's what we're looking for,

and, you know,
we quickly found out

that the persons involved
were not connected.

The murder in wheeling,

as close as it was
to Brad mcgarry's killing,

is just another dead end

that has cost detectives
valuable time,

but detectives press on.

They question another one
of Brad's close friends.

We thought this person might
know who's in Brad's circle.

Who's he close with?

Who is he dating?

Who is he maybe fighting over?

This person told US that
when Brad had a relationship

with a man known as dj,

dj and Brad had met
in the coal mine.

This is the first time
detectives are hearing

about another boyfriend.

We learn that dj was married,
and his wife did not know

that he was
in a relationship with Brad

and that this was a secret
that he kept for years.

And then he tells
investigators dj's real name.

It's a name
they've heard before.

Hold this together.

David Kinney,
Brad mcgarry's best friend

and the man who found Brad
dead in his basement.

Yeah.

Kind of popped out of nowhere.

This dj that he had been
in this relationship

with was David Kinney.

It definitely turned the case
on its axis, you know?

We found out that Brad
pressured David Kinney

on various occasions
to leave his wife

so they could be together.

Up to a couple hours ago,
our whole idea

of the relationship
of David Kinney and Brad mcgarry

is that they were very,
very close friends.

Now we learned that David Kinney
and Brad mcgarry

were involved
in a sexual relationship.

We had to look, was that somehow
connected with Brad's killing?

It was time to have a different
conversation with David Kinney.

Your GPS location is often
going to be

revealed to US on your phone.

I absolutely wanted to see
where Mr. Kinney's phone

was at the time
of the murder.

As detective cruse
reviews David's phone,

chief allar continues
questioning him.

When you see a suspect
start to respond emotionally,

that's the indicator
that you're close to them

reaching some sort of moment

where they're going to
give you something.

He's telling chief allar
in the interview room,

"we're just friends. We're just
friends. We're just friends."

I'm looking through his phone
and seeing,

"we're lovers.
We're lovers. We're lovers."

We're able to see texts,
deleted photos.

But it's what else they find
on David's phone that could be

the most compelling piece
of evidence of all.

Now alls I'm thinking is,
this is going to change

the whole aspect
of this investigation.

The search for Brad mcgarry's
killer has come full circle

and landed right back where
it started with David Kinney.

It was Kinney who found
mcgarry's body,

and now investigators suspect

he was having an affair
with Brad,

an affair Kinney's wife
knew nothing about.

Now investigators are reviewing
the contents of David's phone,

looking to connect him
to Brad's murder.

As I go into his phone,
what I'm looking at,

what I'm seeing
in the text thread

between the two
is they're not just friends.

They're, in fact,
romantically involved.

They're lovers.

He really started to make US
think this guy is hiding a lot.

Detective cruse also recovers
deleted voice messages

from Brad mcgarry,

left just days
before he was killed.

But it's his analysis
of the phone's GPS locator

that's the most revealing.

The most important thing is,
is it's putting him

at the crime scene
at the time of the murder.

Now alls I'm thinking is,
I have to tell chief allar this

because this is going to
change the whole aspect

of this investigation.

We had David Kinney lying to US

about the sexual relationship
with the victim.

We had GPS coordinates
coming that, you know,

would prove
that he was at the house

when the murder took place.

That's not the only piece
of evidence placing David

at the scene after investigators
finally go through

all of the surveillance
footage from Brad's neighbor.

At one point
in the surveillance video,

you'll see David Kinney
arriving at Brad's home

driving his wife's car.

Then you'll see Brad
return home,

and then shortly after Brad
returns home,

you can see David Kinney
leaving the area.

A couple hours later, you see
David returning in his truck

with the family,
which is a direct contrast

to everything we'd been
told prior to.

Armed with this new information,

chief allar
returns to David Kinney

and presses him about
his relationship with Brad.

I tried to put him
at ease about it.

I told him.

I said, you know,
"what year is it? No one cares.

Maybe your wife
is probably going to care,

but as far as society,
no one is going to care.

You like dudes or chicks.
I mean, no one cares."

The interview is going on.

Everything started to flow
rather well.

I had this overwhelming feeling
that David was about

to share
with me what happened.

David and Brad were involved
in this sexual relationship,

and David didn't want more,
but Brad did.

Brad wanted a lot more
than David was willing to give.

Four hours into the interview,

David Kinney starts
to break down.

At one point, David told him,
"hey, we can't do this anymore,"

and Brad was threatening to tell
David's wife about the affair.

David said that Brad
grabbed a .22 pistol

that he had laying
around the basement.

Kinney insists he was afraid
Brad was going to shoot him,

so he snatched the gun away,

but chief allar doesn't buy it.

At no point...None of the
evidence would make US indicate

or believe
that this was self-defense.

I believe David Kinney, with
prior calculation and design,

shot Brad mcgarry twice
in the back of the head.

Then he staged a crime scene.

David Kinney was terrified
of what Brad mcgarry

could do
to blow up his life.

Chief allar takes
David's written statement

and then allows him to
speak with his wife, cheri.

David Kinney is arrested and,
after an 8-day trial,

is convicted of the murder
of Brad mcgarry.

David Kinney was found guilty
of aggravated murder

and sentenced
to life without parole.

The ironic thing is, David
killed somebody that loved him

because he was just
so afraid of this secret

about his alter personality,
his alter life if you will,

being revealed that he was
willing to murder somebody

that loved him over it,

and what's sad is now everybody
knows anyway, and Brad is dead.

I miss hearing that voice.

There's just an emptiness

that nothing
will ever take his place.

My world and a lot of other
worlds are darker now

because Brad is not there
to light our way.

Brad had a whole lot more life
to live and love

to give to so many people.

David Kinney took so much
from this world

when he took Brad mcgarry.

Brad mcgarry could've changed
the world with his kindness

and his loyalty
and his determination.

He had so much to give, and that
was just ripped away from US.
