If a drunk gets behind the wheel
and kills an innocent woman, he's still guilty of homicide,

even though he never
meant to hurt anyone.

The defendant knew
that he had a disease that, at this moment,

is always fatal.

He knew that he could transfer
that disease to Jillian Weeks.

Yes, he was addicted to cocaine

and may not have had
any control over that.

But he did have control
over his sexual behavior.

He could have told her.

He could have prevented
an innocent girl

from an untimely
and horrible fate.

Because he didn't tell her.

Because of his knowledge
and refusal to protect her

by using a condom,
under the law, we can infer intent.

So, if you find that his actions

show such an extreme
indifference to human life,

to the life of that young woman,

then you must convict
Charles Bercik of attempted murder.

Yes, this is a tragic situation.

But what would be
more tragic would be

if innocent people had
no protection under the law

and guilty parties suffered
no retribution for their actions.

That, ladies and gentlemen,
would be the greatest tragedy of all.

We, the jury, find as follows.

As to count one
attempted murder,

we find the defendant,
Charles Bercik, not guilty.
