Terry Sanderson
is essentially claiming

that Gwyneth Paltrow hit him
from behind,

causing him lasting
brain injuries.

It was like somebody
was out of control

and going to hit a tree
and was gonna die.

From day one,
from six years ago,

she's saying,
"Somebody hit me."

She's never changed
her story.

I said, "You skied directly
into my effing back."

This is a man's life

that was permanently changed
by this.

[intense music playing]

Paltrow only asked for $1,

a symbolic amount,

showing that
this wasn't about money,

but about fault.

For Paltrow
and her reputation,

there was a lot at stake here.

Outside the courthouse,
this tape has been put up.

We cannot go beyond this

in terms of trying to talk
to Gwyneth Paltrow.

As the jury,

it was job to determine
who was at fault.

A he said, she said case

is where both parties
are arguing

diametrically opposed
versions of what happened.

[suspenseful music playing]

It was important
for the jury to see my truth.

That day,
when Terry left his home

to go ski in a Deer Valley,

he never returned home
that night as the same Terry.

Mr. Sanderson categorically
hit me on that ski slope.

Determining
who was the uphill skier

and who was the downhill skier

is the $300,000 question
in this case.

At the beginning of 2023...

[phone dings]

I received an email

telling me that I needed to go
to jury selection.

I was very concerned
it was gonna be a murder

or a child abuse case

in which I would've had
a really challenging time.

When I was in jury selection,

they said, "This is Sanderson
versus Paltrow,"

and I didn't really
put together

that this was
Gwyneth Paltrow.

[Judge Holmburg] Okay.
Let the record reflect that

counsel and their clients
are present in the courtroom.

Now that you've been chosen
as jurors,

you are required to decide
this case

based only on the evidence
that you see and hear

in this courtroom.

[Samantha] I had no idea what
a big case this was gonna be.

Never did I think
that this was gonna be

an international
televised event

that people
were interested in.

[Julia] This place is expected
to be packed tomorrow.

There are multiple
media outlets

that are expected
to cover this civil case

along with national
media as well,

and our cameras
are going to be

inside of that courtroom.

Terry Sanderson was suing
actress Gwyneth Paltrow

for over $300,000 in damages
from a ski collision.

I looked very hard

for another celebrity
versus civilian trial

where you have a case that
goes all the way to a jury,

and I couldn't find one,

not in the last
20 or 30 years.

[Judge Holmburg]
This is the case of

Terry Sanderson versus
Gwyneth Paltrow,

case number 190500048.

[Samantha] I don't know
how I didn't hear

about the case before.

I guess it was just old news
at the time,

and I found out the details
in opening statements.

[Bob] There are only
three issues in the case.

Number one, who hit whom?

Okay?

Number two,

did it cause any damage?

Number three,

what are the damages?

Probably the single most
important fact

in determining
who was at fault here

is to determine who was uphill
from the other person.

Under Utah law,
if you are uphill,

you have the duty
to avoid the downhill skier.

When you have a car accident,
the police will tell you,

"Even if the person
hard stopped in front of you,

if you're in the back
and you ran into them,

you're at fault,"

so similar situation
on a ski slope.

She sees two skis appear
between her skis,

and a man comes up
right behind her.

Essentially, the only
two people in this world

who know the truth are Gwyneth
Paltrow and Terry Sanderson.

Going into the trial,

we don't know much about
Terry Sanderson.

The biggest look
anyone had had at him

was in
at the press conference

where he announced that
he was filing this lawsuit.

This is bizarre.

[man] Are you Terry Sanderson?

-[man] Are you Terry?
-I'm Terry.

-Hi.
-[man] Nice to meet you.

The accident happened
in February, 2016,

and it took Terry Sanderson
three years

to file the lawsuit.

He claimed it was because

he couldn't come
to an agreement

with Paltrow's lawyers.

I did reach out.

Um, I figured I...

She had my name for
two or three years, and, um...

And I figured maybe someday
she just contact me and say,

"Hey, you doing all right
and how's everything?"

And... But no, I didn't.

[Daniel B] Terry Sanderson
was a respectable

middle class guy.

He's a retired optometrist.

He seemed nervous,
a little twitchy as well,

and he also seemed
very, very sure

that what he was saying
was the truth.

This little guy who had been
run over on a ski slope

by this powerful
and very wealthy celebrity.

Well, I've skied
for over 30 years.

I've never knocked
anybody down and hurt him.

I've never been knocked down
or gotten hurt.

I think this is kind of
a unique situation.

Terry Sanderson's allegation
was that essentially

this accident was an
inflection point in his life.

Before he was outgoing,
he was sociable.

Afterwards,
he described it as, uh,

living a completely
different life essentially.

[dramatic music playing]

[Karlene] This was one
of our first dates

that we had gone out to eat.

He was very vibrant
and just cute.

I mean, it was like,
there was never

a dull moment with him.

He was just a very energetic,
fun person.

More hiking, we did a lot of
hiking together and, um...

[chuckles]

Yeah, he was... He just
always had a big smile.

He was always just with
huge smile on his face,

just... fun.

He loved to be skiing

and especially
during the wintertime,

and he'd skied for years

and just his own experience
of what he told me.

He was, you know,
very confident on the hill.

This was actually
after the accident.

Look at that, his smile wasn't
quite the same.

Interesting.

He came home
and he's described that

he had been in a ski accident
and somebody had hit him.

And I... At the time,
he didn't even know...

I don't believe he said
Gwyneth Paltrow.

He didn't know who it was.

He just said,
"I had been hit on the hill."

You know,
he was definitely hurt

more than
what he was letting on.

[tense music playing]

I know that there's
press presence in this room,

um, and there are only two,
uh, members of the press

that have authority to record.

[Julia] Judge Kent Holmburg
had approved cameras

inside of the courtroom.

And in in Utah,
this is an open courtroom.

This is public access,

so we would be recording
every minute of this trial.

[woman] Be seated.

[Daniel B]
Paltrow's choice of clothes

and her demeanor
in court were

playing to the jury for sure,

but they're also playing
to the public.

I mean, she knew
it was being televised.

She's been in front
of a camera before,

she understands how it works.

And then in the other corner,
you had Terry Sanderson.

He's just a member
of the public.

So it was gonna be interesting
to see how regular Joe

are compared against
a powerful

and influential celebrity.

Mr. Sykes, you may proceed.

[Terri] Terry Sanderson
was represented by Bob Sykes.

Bob Sykes, in my opinion,

is one of the leading brain
injury attorneys in Utah,

based on his 30 plus years
of experience.

Brain injury took on
particular significance

because
Terry Sanderson alleged

that Ms. Paltrow
had crashed into him

and caused him
a brain injury.

[Julia] This case really
becomes more complicated

because there's a lack
of video evidence.

So we were solely relying
on the testimony

of the two parties
who were in the collision,

and these two other witnesses,

a ski instructor,
Eric Christiansen,

and the friend
of the plaintiff,

Craig Ramon,

who were there at the scene.

[Judge Holmburg]
Good afternoon, everyone.

We're ready for our
first witness, Mr. Sykes?

-[Bob] We are.
-And who would that be?

[Bob] Craig Ramon.

[Julia] Craig Ramon
was certainly on paper,

a star witness
for the plaintiff.

He was going to be the one

to corroborate
the plaintiff's case.

[Bob] Tell the jury,
if you would,

what you saw and heard
that day

at approximately 11:45 a.m.

on February 26th, 2016.

Craig Ramon was the one person

who testified in court
that I'm aware of

that said they saw
the actual moment of impact.

I heard a scream, and then...
And then...

And then I see this skier

just slamming into the back,
Terry.

And when...
And she just slammed him.

-[Bob] How hard?
-Very hard.

He... I mean, very hard.

And he goes, face down

and Gwyneth's
on the top of him,

and they go down like this,

and then Gwyneth hits him

and then bounces off
and slides to the right

about 5 or 10 feet.

[Samantha] Craig's initial
testimony did seem credible.

We were all
a little bit excited thinking

why do we need to hear
anything else

if only one person saw
the collision?

He sees that
Terry is out of it

for some period of time,

and then he starts
talking about

aspects of Terry Sanderson's
mental functioning.

He just didn't know his name,
didn't know where he was at.

So he didn't know
he was at Deer Valley?

-[Craig] No.
-Okay.

That is the type of thing
that is commonly associated

with a brain injury.

[Bob] Now, a few seconds
after you got there,

did someone else arrived
and who?

Yeah. Um, it's Eric.

He showed up.

-[Bob] Eric Christiansen?
-Yes.

Eric Christiansen
is a ski instructor

who was in charge of helping

Gwyneth Paltrow
and her children.

[Bob] At some point,
did you learn the name

of the skier that hit Terry?

Well, she ended up taking off
and going down,

and then, Eric said...

He said, "Gwyneth Paltrow
just took out your buddy."

The fact that Craig Ramon
was the only one

who saw the actual
moment of impact,

I would give a lot of weight

to the person that said
they saw it.

[Bob] I'm sorry. He said what?

[Craig]
He said, "Gwyneth Paltrow

just took out your buddy."

[dramatic music playing]

Good luck today, Gwyneth.

[Daniel B]
Paltrow's legal team

was from a Utah company
called Epperson and Owens.

And her lead council
was Stephen Owens.

And the company is a medical
malpractice company.

So when a patient
has an accident in hospital,

and it's their job
to prove in court

that the patient is lying.

And so going
into the trial, I think

people were, you know,
inclined to believe

that they represent
the bad guys.

I think people looked
at it as if it were

a David and Goliath situation.

-[man 1] Gwyneth.
-[man 2] [indistinct]

[man 1] Gwyneth.

[Bruce] She had more money

to litigate the case with.

Sometimes we'll use
the term war chest.

It's a bit like an arms race,

you know, what resources
can you bring to bear to this?

And there seemed to be
a disparity in that.

[Daniel B]
She is world famous.

She's known
all over the world.

She's got this massive
fortune through goop,

her luxury wellness brand.

It didn't seem
like a fair fight.

Terry Sanderson
wasn't able to hire

a crack medical
malpractice team.

[Judge Holmburg]
Mr. Owens, you may proceed.

Gwyneth Paltrow's lawyers
were absolutely vicious

and they were no more vicious

than when it came

to Terry's daughters.

Essentially, they turned
this guy's family story

against him.

Uh, this is hard.

This is a hard position
you're in.

Do you agree?
This is not a happy thing

that you're having to do?

Correct.

Terry's youngest daughter,
Jenny, didn't testify,

but we heard through
excerpts of a deposition

and questions
of other witnesses

that she had
a very troubled relationship

with Terry growing up.

Jenny is your little sister,
right?

Correct.

Do you agree that you paint

quite a different
picture of your dad

before than Jenny does?

[tense music playing]

[Karlene] He was very close
with his girls.

They loved him.
They talked to him.

We'd visit with them.

When they turned his daughters
against each other,

that bothered me a lot

because I knew all three
of those girls.

-[Polly] So my sister Jenny...
-Yes or no, please.

-[Polly]
has mental disability.
-[Bob] Objection, Your Honor.

-I just have
yes or no questions.
-[Bob] Objection. Objection.

You take any family situation

and, you know,
if it's not the Osmond family,

it's gonna have problems.

But those problems
certainly weren't better

after he got brain injured,
they were worse.

Jenny didn't talk
to your dad for 13 years

after getting out of the house

after high school,
is that true?

[Bob] Objection.
No foundation for that.

-[Polly] No.
-She can... It's not true?

[Karlene] It broke my heart.

That was unfair.
That was unkind.

It was not
an accurate description

at all of what was really
happening with that family.

[dramatic music playing]

[woman] Do you swear
that the testimony

you are about to give
in the case now

before the court will be
the truth, the whole truth,

and nothing but the truth,
so help you God?

-Yes.
-[woman] Thank you.

One of the most
important witnesses

that they put on
was Terry's partner,

who was probably more
intimately acquainted

with him than anyone else.

-[Bob] Good afternoon.
-Good afternoon.

She was able to speak
to what she saw him do

and what he was
no longer able to do.

Well just tell the jury
about the change

in his activity level,
if you would.

He became like an old man.

He didn't want to do
anything anymore.

He wasn't...

Just felt
like he wasn't capable

or just didn't feel
good about it.

His joy was gone.

The personality changes

had to have been

something created
by something.

It was like an overnight
kind of thing.

So it had to be the accident.

He knew he couldn't stay
as energized and connected,

and so he pulled away

and pushed me away

to almost save me

from having
to deal with whatever

it was going on with him.

[Samantha] It was hard
not to feel some sympathy,

especially
for his ex-girlfriend
Karlene.

She is still in love with him.

And to see somebody

change that rapidly
and drastically

can be super emotional
and confusing.

It was like
he wasn't happy anymore.

He couldn't...

He just didn't feel
like the same person.

He lost a lot.

[dramatic music playing]

The lawyers
are getting ready to show you

a videotaped
piece of testimony

and they're just finishing
their preparations for that.

Establishing proximate cause

and the extent
of those injuries

is crucial to any
personal injury case.

[Bob] Is it your opinion
that Dr. Sanderson

had a concussion on or about
February 26th, 2016?

[Dr. Fong] Yes, it is.

[Bob] And that resulted
in a TBI.

[Dr. Fong] It resulted
in what we consider

an MTBI, yes,
a traumatic brain injury.

Bob was bringing
Alina Fong on

because she had treated him

and had tried
to make him better.

It was clear to me

when I saw
Terry's FMRI results

that there was
a definite abnormality

in the way
that his brain was firing.

I'm still saying
the first test for you.

The concussion
was most likely

what caused him to have
these ongoing problems.

Now, for a patient
that is injured

or has had
a traumatic brain injury,

we see quite a bit
of dysregulation

and movement in the red
for many of these

cognitive functions
here that we see listed.

Terry Sanderson first came
to see us in 2017.

He was just someone
that was desperate

to improve and to get back
to this life that he loved.

[Bob] Why did you recommend
that he travel?

I encouraged him
to try to get back

to doing things that he loved.

I did caution him

that he should
not travel alone

because of his memory issues

and other
problem solving issues.

Dr. Fong's findings
with Terry Sanderson

made complete sense.

I think that
he potentially did

suffer a concussion
and was suffering

from post-concussive syndrome.

[Dr. Fong]
When Terry was here,
he was an ideal patient.

He gave his best effort,

but we were nowhere finished.

You know, we were nowhere
to the point where I'd say,

"Yes, he's recovered."

It seemed to me
that Terry Sanderson

was really hurt.

There really
doesn't seem to be

much dispute about that.

I was especially persuaded
by the medical evidence

that showed that his ribs
in the back were broken.

This was an X-ray
taken the day

after his incident.

And I think
the importance of this

is documenting the trauma
that he sustained.

And based upon my analysis

of the X-rays,

I think it's very unlikely

that this
would've been caused

by Terry running
into Gwyneth Paltrow.

It was consistent
with the fact

that Gwyneth
hit him in the back

and it was consistent
with the fact

that it was
a high speed impact.

[dramatic music playing]

-We could bring in the jury.
-[Judge Holmburg] Okay.

-Call them in.
-Let's...

Plaintiff, you may call
your next witness.

Let's call
Mr. Terry Sanderson.

Knowing that Terry Sanderson

was getting on the stand
was clearly a pivotal part

in this trial.

He was going
to tell his story.

Putting Terry Sanderson
on the stand

or any plaintiff
is always a risk

but is one that is expected

because if you're the one

that is claiming
these injuries,

then you need
to tell the jury

your side of this.

I just remember
everything was great

and then, I heard something

I've never heard
of a ski resort

and that was
a bloodcurdling scream.

Just... I can't do it.

It was... [makes sound]

and then, boom.

[Peter]
Terry Sanderson's team
tried to show

that Gwyneth Paltrow
had a habit

of not being safe.

They wanted to bring in
some clips and articles

about her on a scooter

almost crashing
into a school bus.

[bus honking]

But just using one past event

that you can say was not safe

without knowing
all the details around it

is never gonna be able
to be applied

in a trial like this.

Ms. Paltrow went
on Jimmy Kimmel saying,

"Yes, I am accident prone.

I am always running
into things,"

which is very relevant
to this case.

Have you broken
anything before?

I've broken actually toes,

like, probably
eight or ten times.

[Jimmy] Really?
Like all of them?

I don't know.

I don't know what
is wrong with me.

They wanted to prove
that this careless behavior

shown by Gwyneth Paltrow
is the same careless behavior

she used on the ski slopes,

causing her to run
into Terry Sanderson.

And the judge
doesn't allow us to bring in

other acts that a defendant
in a civil case had done

to show that
they must have acted

within that same
propensity or character

that they acted
in a total unrelated manner.

[Judge Holmburg]
Ms. Vanorman, you may proceed.

[Julia] Terry talks
about the collision

and he talked about his life

after the collision.

[Kristin] Have things
in your life changed?

[Terry] I'm like living
another life now.

I've been self-imposed...

90% stayed in the house,
a recluse.

Self-imposed recluse,

just not feeling as fun,

not feeling as engaged
in other things.

[Daniel B] He became
emotional at points.

He went into extensive
detail about the mental,

physical, and other costs

that had happened to him
because of this.

Let's talk about Karlene.

We heard her
testify last week.

She's a catch.
Why'd you let her go?

In my choice,
I wouldn't have but I had...

After eight months,
I had to tell her to leave.

I'm not asking,
now I'm telling you,
you gotta leave.

[Daniel B] They were
very much in love.

They really cared
for each other.

But after the accident,
Sanderson broke it off.

He said something
to the effect of,

"You don't want someone

with brain damage like me.

I'm no good to you.

I can't carry on like this."

It was actually very moving.

[Judge Holmburg] Okay.
We'll take a short recess.

[Karlene]
That was... That was tough.

That was...

Yeah, that was hard.

I...

Yeah, I didn't want
that relationship

to end and then,
to see that afterwards

maybe it didn't have to.

I guess that was
the harder part, not to...

realize that something
truly could've happened there

but at some point,
the, um, I could've stayed

with the man that I adored.

[Kristin] Why did you
bring this lawsuit?

My daddy would say,

if you got the truth,
you bring the truth.

Don't let anybody
back it down.

And that's what I felt
I needed to do.

And I'm here
to prove that truth.

Only the... With facts.

[Kristin]

Mr. Sanderson,
you can certainly step down.

After that first week,
it seemed that they

had a strong case
in front of them.

[man] Gwyneth, comments?

How'd you think today went?

At the end of the day,
the evidence,

more likely than not,
showed that Gwyneth Paltrow

crashed into the back
of Terry Sanderson

and caused a permanent
brain injury.

[Julia] Things begin to shift

for the plaintiffs
on day four.

They call to the stand
the defendant in this case,

the person they're suing.

Your Honor, we'd like
to call Gwyneth Paltrow.

[Judge Holmburg] Thank you.

This case, Gwyneth Paltrow

took the stand
as Terry Sanderson's witness

and she told the exact
opposite story.

And in her testimony
seemed to shift things.

One, two, one, two,
Julia's mic.

We are covering
the case of Gwyneth Paltrow

who's being sued
by a retired optometrist,

but it's only ever so often

that we see these trials
just take over

the news cycle
for all of the outlets

not only at state
but in the country,

even the international outlets

were picking it up
and paying attention

to what was going to happen

with this ski slope case.

Breaking news, we'll take you
to a Utah courtroom

now where
actress Gwyneth Paltrow

is testifying
in her own defense.

[reporter] Retired optometrist
Terry Sanderson says

the actress turned lifestyle
influencer

collided with him on the ski
slopes of Utah

where he sustained
broken ribs

and a brain injury.

It was getting
international attention.

It was getting headlines
all over the world

and the UK and in Japan.

Gwyneth Paltrow
has told the jury

that Mr. Sanderson
crashed into her

and she'd fear
that she was the victim

of a deliberate assault.

[Daniel B]
The whole time it was on,

coverage was everywhere.

It was all over social media.

It was just everywhere.

I believe this trial is set
to go for eight days,

the Gwyneth Paltrow
ski accident trial.

Like most celebrity trials
that are high profile

and publicly streamed,

it became the subject
of many memes...

which is why a lot of people,
especially celebrities,

don't wanna go into
a very public trial

because people
are going to make memes,

make fun of you,
take things out of context.

This was a big story
primarily

because we got to see
an A-list celebrity

in court answering questions
under oath

and she had to tell the truth.

[Brian] It has been
a remarkable day

inside the courthouse.

Gwyneth Paltrow sworn in

shortly before 3:00
this afternoon.

She was poised on the stand.

[woman] Do you swear
that the testimony

you are about to give
in the case now

for the court will be
the truth, the whole truth,

and nothing but the truth,
so help you God?

-Uh-hmm.
-[woman] Thank you.

[Ruth] Paltrow was called
as a witness

for the plaintiffs.

It's not a relaxing situation

to be in a court
before a jury,

no matter
if you're a Golden Globe

or Academy Award winner.

It's still nerve-racking.

The outcome of this
Paltrow ski trial

was really important to
Gwyneth Paltrow's reputation.

She definitely had
a lot to lose.

Right there on that side.

Beautiful.

Gwyneth Paltrow can actually
be a polarizing figure,

even though she's
America's good girl.

[Daniel B]
In 2013, Paltrow was voted

the most hated celebrity

in the world
by Star Magazine.

In the same year,
she was voted

the most beautiful celebrity

in the world
by People Magazine.

And the two are related.

There's a set amount
of tearing down

someone who's beautiful
and successful.

There are people
who love to hate her

and that could play
against her

inside of a courtroom.

I do think
that her reputation

was a little bit mixed,
or was she just

an aloof celebrity that lived

in a world nobody
else could imagine?

[Daniel B] She is best known
for being an actor

who won an Oscar in 1999

for her role
Shakespeare In Love.

In recent years, she's taken

a step back from acting.

It's interesting for me
because I really don't think

of myself much as a woman
in Hollywood anymore.

I kind of have a whole
other job.

[Daniel B] She has two kids,
Apple and Moses,

with Chris Martin,
the singer from Coldplay.

And she's now married for
a second time to Brad Falchuk.

Her priorities have been
her family, Goop,

and you see that from her
posts on Instagram.

I think for her, it's more
important to be there,

be a mom, be around her kids

and not necessarily
be a kind of, you know,

walking the red carpet
celebrity.

[Gwyneth] I do have one
going off to college.

You realize how finite,

it went so quickly.

I feel very blessed
that I've been able

to try to pursue
this other career

and kind of like keep hours,

you know, where I'm able
to be home

and make them dinner
and stuff like that.

Gwyneth Paltrow was
at the Deer Valley Resort

with her two children.

She was there
with her partner Brad Falchuk

and his two children.

This was a significant
trip for us.

That was the first
time Brad and I were...

introducing our kids

and doing something together

as to see if we could
blend families.

And this was their
opportunity to bond

and ski together over
an activity

that she also bonded
with family over.

That kind of testimony
elicited,

uh, an emotional reaction
in the jury

that they saw her now
as one of them,

that this brought her down
to their level

and made her seem
like a normal person.

[woman] Hand you a copy

I'm gonna need my reading
glasses, unfortunately.

Sorry about that.

[Peter] I think her reputation
is important as a celebrity.

I think she probably wanted
to set the record straight

that she did not
cause this accident

and actually
Terry Sanderson ran into her.

I was skiing and two skis came

between my skis,

forcing my legs apart.

And then there was a body
pressing against me

and there was a very strange
grunting noise.

Is this a practical joke?

Is someone like doing
something perverted?

This is really,
really strange.

When something like that
happens where you feel like

you're being
sexually assaulted,

that's a different
kind of memory.

That's a different
kind of thing

where you're gonna always be

traumatized by that.

[woman] You're not saying
to the jury

that this was in any way,
shape, or form

a sexual assault?

-I am not saying that.
-[woman] Okay.

I'm just saying what
went through my mind

for a split second
when it was happening.

When you factor
in the testimony about

how she experienced the hit
and how scared she was,

I think it's more likely
than not that he hit her.

From day one
from six years ago,

she's saying,
"Somebody hit me."

She's never changed her story.

Were you planning
to ski the whole day?

-I was.
-[Stephen] And did you send

a little text,

Contemporaneous statements

are so much more
valuable and credible

than statements that somebody
may make at trial.

[Stephen] Can you read it?

[Gwyneth] It says, "I came in.

That guy sort of hurt me.

I'm gonna get a massage
at 3:00.

if he wants to come."

So when you have
a text message

from Gwyneth Paltrow
just hours

after the accident saying
that this guy hit me,

that tells the jury
that from the jump,

Gwyneth Paltrow believed
Terry Sanderson

was at fault
for this accident.

Do you feel some empathy

for Mr. Sanderson

and his declining brain?

[Gwyneth]
You know, I really do.

I feel very sorry for him.

It seems like he's had
a very difficult life,

but I did not cause
the accident.

So, I cannot be at fault
for anything

that subsequently
happened to him.

Gwyneth Paltrow
did not seem dismissive

to Terry's injuries

or anything caused
by the accident.

However, she was very clear

that this accident
was not her fault.

The defense team
really leaned into this idea

that Paltrow had been targeted
for being a celebrity.

There is a new piece
of evidence in this case,

that's the Mr. Sanderson email
to his daughters

on the day of the accident,

The defense team had
this very revealing email

from Terry Sanderson

where he told other people,
"I'm famous."

This is following
his collision with Paltrow.

[Stephen]
Did you ever say to me,

I wrote, I'm famous...

'cause it's cool that I had
a collision with a celebrity?

I... Not if you
have it on record, no.

I don't deny it.
I don't remember it.

[suspenseful music playing]

It gave the defense
a lot of fodder

in front of the jury
to make it look like

their theme
of the case was correct,

that Terry Sanderson
was looking to be famous

and was looking
to chase a celebrity

and which is why
he was suing Gwyneth Paltrow.

[Stephen]
But it was you, right?

-Right.
-[Stephen] Just to be clear,

when you say it wasn't me,

it was in fact you?

It's the other personality

that's inhabiting
my body right now.

Whether this would've
gone this far,

if it was me that ran
into him, I'd say no.

But the fact that it
was Gwyneth Paltrow

certainly perpetuated
this forward.

[Julia] It was a theme
of the defense

even in their
cross-examination

of Craig Ramon,
the eyewitness.

They were able to show
his messages

where the defense team argued

that it all seemed
to be fixated on the fact

that this was a celebrity

they'd had this chance
encounter with

and wanting to make her pay

for what they alleged
she did to Terry Sanderson.

[Stephen]
Um, Mr. Ramon, Steve Owens.

-We've met before, correct?
-Yes.

[Peter] Part of a juror's job

is to judge the credibility
of witnesses.

There were really only
two witnesses

that heard or saw the events.

That was Eric Christiansen,

Gwyneth Paltrow's
longtime ski instructor,

and Craig Ramon,

Mr. Sanderson's friend.

In fact,
uh, I took a long deposition

of you and a long statement
several years ago.

-True?
-Mmm-hmm.

Did you once...

in that deposition say...

that Eric Christiansen

told you that Gwyneth
took Terry out?

No.

Craig Ramon
became very flustered

in his cross-examination.

A lot of his answers
to questions were changing.

[Stephen]
Did you say that today?

[Craig] Uh, no.

What I... What I meant to say,

I get dyslexic
when I get nervous.

No. He said that your buddy
just took out Gwyneth.

[Stephen]
Okay. So, Christiansen

always said your buddy...

took out Gwyneth Paltrow,
right?

-[Craig] Yes.
-All right.

So, it was really hard
for the jury

to understand
what was the truth

from Craig Ramon's testimony.

[suspenseful music playing]

Eric Christiansen
was able to talk about

what happened
just before he said Paltrow

was skiing perfectly,

that he turned his head

before the moment
of collision.

Mr. Sanderson was skiing down,

making fairly large turns,

and he had accumulated
a fair amount of speed.

At that point,
he was very close

to Ms. Paltrow

and, uh, I looked away.

I did not actually
see the collision,

but I heard her scream.

And that's when I looked up.

[Samantha]
His story was consistent.

He never claimed
he saw the accident.

He always said,
"I heard and I turned,

and this is what I saw."

Did you hear Mr. Sanderson

say anything during
the entire incident?

He simply said,
"I'm sorry. I'm sorry."

Uh, but then he also

made a statement about,

"She just appeared
in front of me."

This is something that
the jury was going to have

to determine, which party
was at the top

and which one had
the right-of-way,

uh, at the bottom.

In the skier's code,

the most important role

is that if you're
the uphill skier,

you need to always be
looking downhill

and avoiding the path
of the downhill skier

to prevent collision.

[Stephen] Okay.
You remember those words?

-Yes.
-[Stephen] What would that

indicate to you in terms
of who was the uphill skier?

It'd be very difficult
to be underneath her

if he hadn't hit her
from behind.

[Ruth] You had Dr. Sanderson
indicating

that he was downhill.

You have Ms. Paltrow
indicating she was downhill.

And obviously based
on the laws of physics,

they can't both be uphill
of each other.

[suspenseful music playing]

In the first week,
I would say approximately 90%

of the testimony
was in regards

to Terry Sanderson's
health conditions.

The central argument
was that the collision

had essentially debilitated
his life.

The most common argument
any defense attorney makes

with causation of damages
and the damages themselves

is that they were
already there.

They were pre-existing.

Stephen Owens
was really able to counter

almost everything
that the plaintiffs brought

in their case in chief

when it came
to these injuries.

[Dr. Hoesch] The head injury
was very mild.

I mean, it fell in the most
mild category of concussion.

There were no clear signs
like dizziness, nausea,

um, vomiting,
any double or blurry vision.

He emphatically states
there is no evidence

of post-traumatic brain injury
in his report.

[Stephen] Do you believe
he had a concussion?

It's questionable.

That's all. Thank you.

When you say you have
a permanent brain injury

that ruined your life,
you open the door

to the defense showing
your life

really isn't that different.

Mr. Owens, you may proceed.

Oh, [indistinct]

Then during
the cross-examination

of Terry Sanderson,

Owens pulls out
these pictures.

-after the collision.
-[Terry] Okay.

[Stephen] Okay. Page 63.

Is this you skiing
after the collision?

[Terry] Um, it could be.

[Stephen]
Well, I... I'm asserting

that this is you skiing
after the collision.

Do you dispute it?

[Terry]
It was that following year.

I don't dispute it.

Owens has pictures
of Terry on trips

from all of these
different countries

and he was able to show him
happy and enjoying himself.

[Stephen]
Every one of these pictures

is after the collision.

Page 73.

Is this you on a bike ride

-looking fit and happy, yes?
-[Terry] Yes.

[Stephen] Eighty.
Are you in this river cruise,

river boat?

I believe so.

-[Stephen] Okay.
-[Terry] Yeah.

When a plaintiff
makes a statement,

it better be true
because if it's not

and the defense can prove
it's not true,

you'll lose credibility
for everything else.

[Julia] If the jurors hadn't
made up their mind

by that point about
liability,

they had after
all those photos.

The picture that
was painted this man

that was unable to travel,

unable to function,
didn't have friends,

yet he's traveling the world,
it didn't add up.

[Stephen] No more questions,
Your Honor.

Thank you, Mr. Sanderson.

Thank you.

Steve Owen and his team
did a good job

of presenting experts as
well as fact witnesses

to turn Sanderson's story
180 degrees.

Let's begin
just by just asking you

what you understand
your role here to be today.

To teach the jury about
biomechanical engineering

related to snow sports,
in particular, skiing.

Dr. Scher used an animation

of what we call
demonstrative exhibits.

[Julia]
This animation was perhaps

the most talked about
part of the trial.

It showed you what
it likely looked like

when this collision happened.

[Dr. Scher] It's her testimony

that his skis slid
between hers.

She felt a contact directly
in the back, along her back,

but they were on their skids
for a period of time.

So as she's rotating

and he's rotating
counterclockwise,

they fall at the side.

As they hit the snow,

they would continue
to move forward

until friction
slows them down.

Logically speaking,
this video not only lines up

with what
Gwyneth Paltrow said,

but what Eric Christiansen
said and what Dr. Scher said.

I think once you see it

and you see it all happen
and how the bodies move,

and how the collision happens,

that's something
that can stick in your brain.

That's really damning
for Terry Sanderson's team.

I was ordered not to talk

about the case to my family,

friends, co-workers, anybody.

So I recorded myself every day

just to remember

and just to have somebody
to talk to.

But yesterday, we had
a really interesting turn

because we had
a biomechanical engineer

who made Gwyneth's
very odd story

made a little more sense.

The animation was
demonstrative evidence,

meaning that we
couldn't really

consider that as evidence

but it did help the jury
to just vision

what we had already thought
was happening.

I was surprised
that Bob Sykes

and Dr. Sanderson did not
have a demonstrative exhibit

to support his version.

And it could've just been
a strategy on their part,

but I do think
it was a mistake.

One of the reasons
why the case was brought

in Park City

was because the ski resort

was domiciled here
in Summit County.

Deer Valley is very,
very exclusive.

As we heard during the trial,

the ski lessons
for Paltrow's two kids

over the course of just
a few days cost $9,000,

which gives you an idea

of how expensive
this place is.

[Bruce] Park City
is a resort town

and most of the jury pool

is gonna have some connection
with skiing.

And there are actually
voir dire instructions

to try to address those
sentiments by jurors.

The whole voir dire process
is to try to ferret that out.

[Samantha] Skiing
is the number one reason

that people visit Park city.

It's a huge part
of our economy,

our jobs are all related
to skiing.

[Karlene] I believe
that the jury

had to be slanted
in their opinions.

They were skiers and part
of the Deer Valley community.

Park City didn't wanna lose
their celebrity status

of stars coming in
and participating

in what it is they had
to offer there

at Deer Valley and Park City.

If a large jury award

is rendered against
a local entity,

it may have some effect
on the economy,

so that could be
a disadvantage

for Terry Sanderson.

[Daniel W] So a long day
of testimony today

here in Park City.

It will continue tomorrow.

We do expect the jury
may get the case to begin

deliberating sometime
later on Thursday.

[dramatic music playing]

After eight days
of hearing testimony

in this case from witnesses,

jury then retired
to deliberate this case.

[dramatic music playing]

Members of the jury,

you have now received
all of the evidence.

Finally, you will go
to the jury room

to decide the case.

During these eight days,
I have never felt

such a heavy weight
on my shoulders

knowing I'd have to go through
all of this evaluation

and determine who was lying
and who was telling the truth.

[Julia] The jury had options
when it came to this verdict.

They could either
find Gwyneth Paltrow

liable for the damages
that she was accused of.

They could find
Terry Sanderson

liable of the injuries

that he claimed Paltrow
committed against him.

[dramatic music playing]

[Samantha] We were
in deliberation

for approximately two hours.

The first portion
was determining

who was at fault
for the accident.

Second portion
was determining

what percentage of fault
was to be awarded.

[Julia] When a jury
deliberates for two hours

after such a lengthy trial,

that tells me that they knew
going in pretty much

what they were
going to decide.

It was surprising
to see everyone

was on the same page.

There was a lot at stake

as far as Gwyneth Paltrow
was concerned

because if the ruling
went against her,

people are going to think,

"Why are you not
just settling this case?

Why did you let this go
all the way to trial?"

[Bruce] This is a man's life

that was permanently
changed by this.

I can't imagine
that he would've wanted

to go through this

just to face this ridicule
because he was not serious

about what happened to him.

[man] We'll now have the clerk
read the verdict.

I watched
Gwyneth Paltrow's face

as the verdict was being read.

[woman] Was Gwyneth Paltrow
at fault? No.

Was Terry Sanderson
at fault? Yes.

Comparative fault.

What percent of the fault

do you assign
to Terry Sanderson?

100%.

When Gwyneth Paltrow
heard that,

you could tell
that she was relieved.

Let's bring in Court TV

Julia, wow, like, boom. Boom.

It's like, "No, no, Gwyneth
did nothing wrong here,

it was you, Terry Sanderson."

It was a bit of a shock
for journalists to hear

that not only the jury
came back with a verdict

so quickly, only two hours,

but that they also had not
found any negligence

on the side of Paltrow.

Vinnie, a scathing loss

for the plaintiff
in this case.

I think the jury reached
the verdict they did

because Mr. Sanderson's story
had too many holes in it.

I wouldn't go into whether
or not it's fair or not

because I think
it's fair for the jury

to reach its own conclusions.

But I thought
that the evidence

was much more convincing
the other way.

In talking to those
who deliberated this case,

it sounded like they really
believed Paltrow

when she took the stand.

It was almost black and white
at the end

that there was no way

the collision
could've happened

in the way that
Terry Sanderson

was saying that it happened.

[Karlene] He came home
and he's described

that he had been
in a ski accident

and somebody had hit him.

He would not tell me
and create something

that was false.

She is a centimillionaire,
two times over,

and she was able to bring in
this animation

that she'd created.

And those resources

did not seem as readily
available to him.

That was one of the factors
that weighed

into the disparity
in the case

was that she had more money
and resources

to litigate the case with.

Terry Sanderson's story
lost a lot of credibility

when I saw the images
of him on vacation.

These were posts
that were brought into court

that we could clearly
see this man

was still enjoying his life.

It was very disheartening
as a healthcare provider

to see that recommendations
that I provided to him

as part of his ongoing
recovery

was turned around in a way

and used against him
as part of an attack.

Part of Terry's love
and passion was travel

and that was part
of his recovery

was to get back to travel

and get back to some semblance

of an increased
quality of life.

[man] This court is now

I think this case was great
for Gwyneth Paltrow.

She fought for the truth
and she won.

So I think it has salvaged
her reputation

quite significantly.

Once these parties
were dismissed,

she walked over past
the plaintiff's table,

she leaned over,
whispered something

in Terry Sanderson's ear,
and then, she left.

We were all very curious
as to what she said

in that moment
to Terry Sanderson

while all eyes were watching.

[man] Did Gwyneth Paltrow
touch you as she left?

-She did.
-[man] And what...

Her exact words,
"I wish you well."

-Very kind of her.
-That's all she said?

-That's all she said.
-Okay. And did you respond?

I said, "Thank you, dear."

Showing compassion
and grace to someone

who's put you through
a difficult ordeal

is classy and decent.

[Peter] The outcome of this
trial had a positive effect

on how the public views
Gwyneth Paltrow.

I think she came off
as honest,

I think she came off
as credible.

Gwyneth has always
had a history

of advocating for what
she believes in this...

Believes in and this statement
was no different.

And she will continue
to stand up for what is right.

Proving you were right
and being able to tell

your side of the story,
I think it's something

that's really important
for any individual.
