by Daniel Puner on a reference

from the criminal cases
review commission

against his conviction
on November 13th, 1987

before Justice Levi
and the jury of the Crown Court

of East Sussex on the murder
of his father Harold Puner.

On the morning
of November 1st, 1987,

Mr. Harold Puner, age 54,
was found crushed to death

under the washing machine
of the appellant

and his father's launderette
in East Sussex.

The prosecution's case was that

about 10:00 p.m.
the night before,

he had deliberately in a rage,
picked up a heavy metal block,

a compartment
of the washing machine

and smashed
his father's head repeatedly

until and beyond
the point of death.

The defense's case was that
the appellant had been

in a state of mental illness
at the time of crime.

The critical issue on which

the judge directed
the jury was whether

when he dropped the metal
block on his father's head--
