Common Law Court Basic Requirements

Personal accountability is freedom.

Structure for a Common Law Court Hearing

You will need

1.

You - The Plaintiff versus The Defender or defenders

who is an individual or individuals.

The necessary Court Officers

This requires a minimum of 17 people:

An adjudicator

A sheriff

A secretary

Two bailiffs

and Twelve jury members

The Adjudicator

Ensures the efficient, lawful running

of the Common Law Court process from start to finish.

This will include giving required directions

and to make sure that the jury of peers

can deliberate in private,

to reach their decisions.

The Sheriff

Is an observer of the process

but does not take an active part until the conclusion.

The Sheriff is allowed to question
the Plaintiff or Defender,

if he thinks clarification would assist the jury.

They sign off on the court paperwork

and can deputize people

to enforce Common Law Court decrees and judgements.

The Secretary Is responsible

for all court paperwork.

And will ensure that the Common Law Court paperwork

is in order and then countersigns it.

Bailiffs

The bailiffs are responsible for ensuring

that the jury of peers maintain Common Law Court conditions.

And Liaise with the adjudicator

if the jury needs to ask any questions

and accompanies individual
members of the jury to the toilet,

always leaving another bailiff with the rest of the jury.

Jury of Peers

The most important part of the Common Law Court,

as they are required to act under their oath,

on behalf of the people

and to reach unanimous decisions and sanctions,

which are based upon the facts

presented before them

by the Plaintiff and Defender.

If no Defender appears,

they will take this to be a tacit admission of guilt

and will take this on board

when making their decisions and sanctions.

The decisions and sanctions of the Common Law Court

are final and cannot be challenged

unless it can be shown

that there was a direct family link

with either the Plaintiff or Defender

or that evidence has been deliberately withheld

or tampered with.

The jury of peers will not be led,

coerced or criticised,

will remain solely in charge

and trusted to act, according to their Common Law Court oath

and their own conscience,

remembering that they are acting

on behalf of the people.

While their identities will
remain undisclosed to the public,

they must be able to justify their decisions to the jury

during deliberations.

How it works

If you have a prime facie case,

contact the Common Law Court through info@commonlawcourt.com

for advice on how to prepare

your documents, evidence and testimony

into a proper and concise form.

Once you [The Plaintiff]

are happy that your case is complete,

send this documentary package to the Common Law Court

and serve an identical copy on the Defender

or Defenders.

You cite them to appear at a Common Law Court hearing,

using the Common Law Court citation proforma,

giving them a time, place

and at least 10 days notice.

The Common Law Court citing proforma

will invite the Defender or Defenders

to contact you

under an offer of mediation,

which must be completed before

the commencement of the Common Law Court hearing.

The Plaintiff will make the hearing public

and will give a minimum

of 24 hours notice to attend,

this can be done

by posting on the Common Law Court website

and/or at the venue for the hearing.

The Plaintiff notifies the Common Law Court

that they wish to right a wrong or wrongs

then prepares a package of evidence

and cites the Defender.

The Defender has three options:

1.

Submit their defence documents to the Common Law Court

and to the Plaintiff prior to the hearing.

They will also appear in person

to lead their own defence

They will not be allowed to be
represented by a statute solicitor

2.

Enter into mediation with the Plaintiff

so as to settle the case,

prior to the Common Law Court hearing.

3.

If the Defender[s] submits paperwork

but does not appear for the hearing,

then a member of the public

can read out their paperwork to the jury.

If there is no conclusion by mediation

then the Common Law Court hearing will commence

From the assembled public,

the adjudicator will ask for volunteers

to become officers of the Common Law Court

A minimum of 17 people are required, as described above.

If more than 17 people want to take part,

then the adjudicator can choose

to have a larger jury and/or number of bailiffs.

At this point the volunteers may not know

what the details and facts of the case are,

or information about who the parties are.

It is good practice for the adjudicator

to invite all potential court officers

to visit the toilet before commencing

and to ask them to turn their telephones off.

Toilet breaks throughout a hearing can be disruptive

but an adjudicator must use their discretion

as to when to allow a toilet break,

anyone requiring a toilet break

will be accompanied to and from the toilet by a bailiff.

The adjudicator, will ensure

that all of the court officers
swear the Common Law Court oath

and on taking the oath,

they will be bound by Common Law Court conditions,

they will not be able to access telephones

or speak to anyone outside of the court officers.

The secretary will,

with the adjudicators guidance,

hand out the court paperwork

to be signed by the court officers,

recording their name

and a contact address or telephone number

as well as their written confirmation

that they will act according to the Common Law Court Oath.

The adjudicator will invite the jury of peers

to sit together, facing the Plaintiff

and Defenders who will address the jury.

The bailiffs are situated next to the jury,

With the sheriff and secretary sitting together,

apart from the jury.

The adjudicator will ask the secretary

to hand out the Plaintiff's document package

to each court officer,

this does not include the bailiffs.

The adjudicator will then call the case

announcing the parties

and the adjudicator will invite the Plaintiff

to address the jury

with their presentation and evidence,

without interruption.

Normally,

questions are raised by the Plaintiff and/or Defendant,

but when there is no Defendant,

the Jury and/or sheriff will be
allowed to ask limited questions,

if they think that will aid the understanding of the jury.

The Plaintiff will swear the Common Law
Court oath before addressing the jury.

The Defender will swear the Common Law
Court oath before addressing the jury.

Only when the Plaintiff has finished their presentation

will the adjudicator ask the Defender

if they wish to ask any questions?

If the Defender did turn up,

the adjudicator will invite them to present their case

and the secretary will ensure

that their paperwork is handed out, if any,

to the same court officers.

When the Defender or Defenders

have finished their presentation

the adjudicator will invite the Plaintiff to ask questions.

If the Defender does not answer
the Common Law Court citation,

does not enter into mediation

and does not appear to defend the case against them,

then the jury would have no defence to rely on.

This can also be taken

as a tacit admission of guilt,

so long as the Plaintiff has “signed-for”

proof of postage of the Common Law Court citation.

The Unanimous Decision

The adjudicator will now remind
the jury of their responsibilities,

they will ask them to select

a chairman of the jury from their number,

who will record their verdict and sanctions

on the Common Law Court court provided paperwork.

They will also verbally announce

the jury's decisions after deliberations.

The jury will be invited to retire

to deliberate, accompanied by the bailiff's.

Any viewing members of the public will leave the room

to give the jury privacy.

Once the jury have reached their decisions and sanctions,

they will be announced.

The adjudicator will once more ask the jury members

if they concur that it was indeed

a unanimous decision and sanction.

The adjudicator will confirm

that the jury's Common Law Court
paperwork is signed and dated

and the Common Law Court secretary
and the sheriff will be asked

to countersign the Common Law Court paperwork.

The court officers will then be discharged

and the findings will be sent to
the Common Law Court for recording.

The jury chairman has the responsibility

of ensuring that jury members get an opportunity

to debate, discuss and agree,

according to their Common Law Court oath.

If the jury feel the need to do so,

they can vote to remove the jury chairman,

if they believe that there has
been any unacceptable behaviour.

It is for the jury to reach their own decision.

The Common Law Court court paperwork
will have clear instructions

regarding the remedy that is being sought,

with the sums or other arrangements requested.

The jury may be guided by this

but are entitled to reach whatever decision they deem

to be relevant, proportional and reasonable,

after considering all circumstances, relating to the case.
