So we tend not to make fast money with print-on-demand.

We start our business.

We Skillet up over time and we reap the rewards

down the line in the future from the work that

we put in today,

but that can all be threatened.

If we don't understand how the rules of intellectual property

work and apply to what we can and can't sell.

This is what I called the Golden Rule.

And I'm going to highlight specifically trademarks in this lecture.

We really need to understand trademarks.

Now,

I'm going to try to just show you the exactly

what you need to know.

When I'm going to give you some examples along the

way.

So let's use this t-shirt as an example.

It says will you shut up,

man?

If you guys remember Joe Biden said that in a

presidential debate and t-shirts were like flying off the shelves,

saying,

will you shut up,

man?

But,

but are we okay to sell this?

Let's look into it.

So we're going to go to tmsearch.

Uspto.gov.

I keep this bookmarked and I will put a link

to this in the lecture.

Okay,

when you get to this page,

by the way,

click basic word Mark search there at the top under

select an option.

Basic word word Mark search.

Okay.

Now you're able to provide Search terms.

So we type in.

Will you shut up,

man?

And we hit enter or you can click submit query.

Alright,

now we see three results in all three say live

under the live dead indicator.

So is this okay to sell?

Well,

I'm not going to bury the lede,

it is okay to sell.

And here's why do you see the column called rag

number?

And I'm going to highlight this in a little bit,

but I just want to show you right now in

front.

The second column the one next to serial number that

says rag.

Number,

if you don't see a number under there along with

a live in Decatur and then you're okay.

Okay,

but if you do see a red number and they

live in Decatur and then you need to click it

and see what it is protecting.

When I say,

what is protecting,

do you see here?

This is what happens.

When you click a record.

You see where it says goods and services and it

says political party Services,

namely promoting the interest of a political organization.

So what it does not say his shirt or clothing

and the easiest way to search is actually just on

your keyboard,

hold down the Ctrl button.

And hit fvs will allow you to type in a

word and your web browser will search the whole page

for that word.

So what I do is I'll come to this page.

I'll hit Ctrl F and I type in shirt or

typing clothing.

All right.

So here is another instance.

This is the second record that showed up in the

results.

And it says,

okay,

it's live when I did a control at the search

for shirts.

Look how many hits we got on the word shirt?

Okay.

Well,

this is one.

We need to be aware of because they are trying

to trade mark this or use on lots of different

clothing and shirts.

But remember what I said earlier,

it did did not have the registered number,

the registration record number.

And the third one also is trying to get this

on sweatshirts t-shirts,

Etc.

Saw us,

another one.

That would pose a potential issue to us down the

line.

But here's the thing,

after the attempt to register guys.

It takes about nine months to a year.

So if this is like days after,

why didn't,

you know,

says the,

the quote then you have like nine months to a

year,

most likely of being able to sell.

Alright,

so I look at Amazon.

And,

by the way,

I used the search merch tool to filter out non

Amazon,

murch products,

which I'll put a link to it in the description.

And that,

that way,

you know,

this is assuming like,

if we're selling Amazon murch,

that we want to search commercial products.

Okay?

For not selling through Amazon murch,

then we don't need to be as worried about the

content policy even though it does still apply.

But like you really need to know your platform.

Like,

if you're selling on Etsy,

they don't you trademark audition.

You're selling on Amazon Seller Central,

they don't you trademark audition you sell on Redbubble.

They don't do trademark.

Validation of me.

They do a little bit,

but you kind of learn how the algorithm work on

each platform on Amazon Verge do we know they do

trademark validation?

So,

it's extremely important to look at Amazon,

merch,

t-shirts,

and evaluate.

What are be selling?

This is a big thing.

They recommend doing look at with Artie telling the good

indicator of if you are allowed to sell it or

not.

Not a perfect indicator.

And by the way,

I'm not recommending that you should be infringing on people's

IP,

which means intellectual property,

just because you can get away with it.

That's Very short-term solution to something that will not work

long-term and you'll end up losing your account K.

So we will,

you shut up,

man.

We see lots of Amazon merch.

Products that say this implying that they should be safe.

And here is how we know it's safe.

So on the record,

the second one that had about 30 instances of the

word shirt.

Meaning they're trying to protect this freeze on shirts.

You'll see under owner.

It says in parentheses in all caps.

It says applicant,

instead of registrant K.

That's a big one to remember.

Dayton.

And here's the third record,

that also said shirts and it says applicant not registrant.

So that is not posing a threat to us in

the immediate future but it's something you have to monitor

down the line and I actually have a solution for

how you can do automated monitoring that I'll share with

you in a second example,

that showed me basically.

Now something that looks too many people that don't understand

how trademarks work like it is trademark,

you know,

cuz they said always says live but no,

it's not registered yet.

Okay,

so I guess that means it's okay.

I'm just saying anybody can file a trademark and attempt

to register almost anything.

It doesn't mean you'll get it though.

Okay,

it's a process.

The long process.

I know firsthand got a couple trademarks.

I'm not about to,

I don't know.

I don't own t-shirt trademarks before.

Anybody asks.

I want to have them for my Amazon FBA business.

All right here,

let's do geocaching as an example.

So,

I type this into my search merch tool,

which will filter out,

in,

on Amazon,

merch products,

and boom.

Geocaching returns multiple results that say Geocaching in

the title.

Okay.

So the fact that it actually says the word in

the title and they're not trying to game the system

by,

you know,

sometimes people actually slip through the content algorithm when they're

maybe not doing a one word phrase,

but what they'll do is if it's like multiple words,

they will join the words together by using periods.

Instead of spaces and Amazon,

search will still index it,

but it'll get past the content algorithm.

Now again,

I'm not telling you that and implying that you should

do that.

You should not do that.

But I just want to let you know that when

you are searching and evaluating,

If This Were to stay for not,

you may see instances of that occurring and you need

to know better than to think that means it's safe.

Okay,

so geocaching looks safe,

but I go to the TM search that uspto.gov

and perform a search again.

Edward Mark,

search.

This is what we see.

We see this record right here,

says,

it is protected on goods and services,

clothing,

namely shirts.

That's not good for us.

And then registration date June 27th.

2017 owner,

says registrant,

when you see that guy's and then live dead indicator,

says live.

That's a big No-No.

Stay away.

Even if you see shirts on merch by Amazon bedding,

fly that it's okay,

you know,

these could be pushed by the trademark owner and even

if they're not it's not worth the risk guys and

just to make matters worse.

There's a second record.

That is that's registered that's live,

and then also is protecting on clothing,

namely shirts.

So I would not sell anything on where to buy

Amazon on Etsy on Redbubble,

on Dollar Central on wherever you sell.

I would stay away from the word geocaching.

Okay.

I just want to illustrate that now,

Are the trademark application process is usually takes three to

four months just to get your trademark application to reach

the top of the queue for examination.

Okay.

So when we say like 9 to 12 months,

like it's that's about what it takes.

And there is a Facebook group called trademark,

watch dogs.

They're pretty much entire existence is dedicated to stopping what

they call frivolous trademarks,

especially applies to like print-on-demand.

I'll put a link to this group in case you

want to join.

They are awesome.

I also have like a YouTube video where I think

I have like a 40-minute conversation with somebody from that

group and admin who is an expert in case.

This isn't an interest you we go deep.

All right.

And I just wanted to before I close this show,

you that merch Informer and I have not seen a

free tool.

I know merch Informer.

They paid tool what merchant former has the ability for

you to insert keywords.

For instance.

Like if you sell a will you shut up man

shirt,

you know,

like I said,

you could get away with it for a while.

But if any of those trademarks actually,

get registered.

Your need to pull your products down like immediately before

the March algorithm does a scan and says,

oh well,

now this is registered.

So now we need to pull down all the products

that say this will you shut up,

man.

You can actually put that freeze in here and you

can put a whole list in and working former will

repeatedly check the USB to a database for you using

Automation.

And look for if that trademark actually goes and gets

registered.

And if it does,

they will alert you that you need to pull down

your products that contain that.

So it's want to let you know that that is
